Criminal law in medieval and early modern era in the city of Cheb area, focused on the issue of executioners

Abstract:

Diplomová práce se v obecné rovině věnuje problematice středověkého a raně novověkého trestního práva. Konkrétně je zaměřena na specifika pro trestní právo v oblasti Chebska. V první části práce je věnována pozornost středověké a raně novověké společnosti a jejím specifikům. Charakteristika je zaměřena hlavně na problematiku tzv. lidí na okraji společnosti, nečestných povolání a fenoménu osobní cti. Hlavním tématem práce je problematika katů a jejich postavení jakožto difamovaných osob v rámci tehdejší společnosti. Popis těchto osob se dále týká jejich činnosti a výskytu v tomto regionu. V neposlední řadě je práce zaměřena také na příjem kata. V další části je zpracován průběh tehdejšího trestního procesu, jednotlivé druhy trestů smrti a jiných tělesných trestů včetně průběhu samotné popravy. Poslední část práce je věnována charakteristice Chebského městského státu, jeho správnímu a právnímu vývoji. Výzkumná část práce se opírá o zahraniční literaturu německých autorů a chebských archivářů K. Siegla, H. Gradla a H. Sturma. V rámci výzkumu jsou zpracovány tři nejstarší chebské kroniky (Chronik des Pankraz Engelhart; 2) Manual-Chronik des Andreas Baier;3) Johannes Brusch Chronik). Výzkum byl zaměřen na výskyt jednotlivých poprav v Chebu v 16. století a na jejich další zpracování.

Abstract:

This thesis deals with the general problems of the medieval and early modern criminal law. It especially focuses on the specifics of the criminal law in the area of Cheb. The first part is devoted to the medieval and early modern society and its specificities, mainly focusing on the issues of the people in the margins of society, dishonest professions and the phenomenon of personal honor. The main topic of this thesis is the issue of executioners and their status as unworthy people within the society. The description of these people further relates to their occurrence and activities in the region of Cheb. Finally, the thesis also focuses on the income of executioners. The next part includes the process of death penalties and other corporal punishment, including the process of the actual execution itself. The final part focuses on the characteristics of the city of Cheb, its administrative and legal developments. The research section is based on foreign literature from German authors and Cheb archivists K. Siegl, H. and H. Sturm. Regarding research, three of the oldest Cheb Chronicles (Chronik des Pankraz Engelhart; 2) Manual-Chronik des Andreas Baier; 3) Johannes Brusch Chronik) were utilized. The research focused on the occurrence of individual executions in Cheb in the 16th century and their further processing.
