Pleading of an accused and his position in a punishable proceeding

Abstract:

In my bachelor's work I deal with a plea of an accused and his position in a punishable proceeding. It is widespread problem that is being changed lately, due to this fact I couldn't concern deeper this case. The principles including in the punishable proceeding are concered in the first part.The second part is about the accused and his rights for the plea. I deal with an enforcement of the punishment in the third part. The fourth and fifth part of my work I examine progress of the preparing trial and the main process closely. The sixth and seventh part gives some possibilities appellate trial and exceptional reparative means. The eight part, I concern a role of the justifier and his task in providing all rights of the accused. In my work I deal with those aspects of the plea of the accused that have been changed over the approximation of contradictable factors in the punishable proceeding. The conclusion summarizes information of all parts.

Abstract:

Vo svojej bakalárskej práci sa zaoberám obhajobou obvineného a jeho postavením v trestnom konaní. Vzhľadom na to, že ide o veľmi širokú problematiku, ktorá v nedávnom období prešla rozsiahlymi zmenami som sa nemohla niektorým témam venovať tak podrobne, ako si to pre svoj význam zasluhujú. Pojmom, ktoré sú obsiahnuté v trestnom konaní sa venujem v prvej kapitole. V druhej kapitole sa zaoberám zadržanou osobou a jej právami na obhajobu. Tretia kapitola je zameraná na výkon väzby. V štvrtej a piatej kapitole rozoberám priebeh prípravného konania a hlavného pojednávania. Šiesta a siedma kapitola uvádza možnosti odvolacieho konania a mimoriadnych opravných prostriedkov. V poslednej ôsmej kapitole som popísala postavenie obhajcu a jeho úlohy pri zabezpečovaní práv obvineného. V práci rozoberám tie aspekty obhajoby obvineného, ktoré prešli najvýraznejšími zmenami pri aproximácii kontradiktórnych prvkov trestného konania. V závere som sa snažila zhrnúť poznatky z jednotlivých kapitol.
