Proprietary rights of a copyright and a licence agreement

Abstract:

Diplomová práce - Majetková práva autorská a licenční smlouva - pojednává o současné legislativní úpravě majetkových práv autorských, která současný zákon vymezuje podle způsobů užití díla a dále o institutu licenční smlouvy, což je klíčový právní pojem relativizace výlučných autorských majetkových práv. Cílem diplomové práce je zhodnocení platné právní úpravy v České republice, s přihlédnutím k zahraniční a komunitární úpravě. Diplomová práce je dělena na dva, resp. tři stěžejní celky, z čehož první celek je věnován úvodu do samotné autorskoprávní problematiky. V této první části je shrnut samotný pojem, předmět, principy, funkce a koncepce autorského práva, stručně zhodnocena historie s ohledem na mezinárodní a komunitární vývoj. Druhá část práce se zabývá užitím díla v hmotné a nehmotné podobě, blíže specifikuje jednotlivé druhy užití, dále konkretizuje tzv. jiná majetková práva, zmíněna je rovněž problematika trvání majetkových autorských práv. V poslední části se diplomová práce věnuje problematice licenční smlouvy, zejména pojmu, náležitostem a licenční odměně, jednotlivým typům licence a skutečnostem vedoucím k zániku licence. Autorka práce prokládá jednotlivé kapitoly příklady z praxe, tj. judikaturou a souvisejícími články, které byly uveřejněny v odborných časopisech. Z uvedené judikatury jednoznačně vyplývají odlišné přístupy v rozhodování soudů i přístupu k jednotlivým institutům. V závěru práce je uvedeno zhodnocení diplomové práce s odkazem na aktuální rozhodnutí Ústavního soudu, které bylo podnětem ke zkoumání souladu současné tuzemské úpravy s úpravou unijní.

Abstract:

The thesis - Proprietary Copyrights and Licence Agreement - discusses the existing legislation regulating proprietary copyrights, which are defined in the existing laws on the basis of the manners of exploitation of the relevant work, and the concept of licence agreement, i.e. the key legal concept of relativisation of exclusive proprietary copyrights. The objective of the thesis is to evaluate the legislation in the Czech Republic while taking into account foreign and Community provisions. The thesis is divided into two, or rather three key parts, with the first part providing an introduction to the copyright issues. It summarises the very notion, subject-matter, principles, functions and concept of copyright and provides a brief overview of the history, taking into consideration international and Community development. The second part of the thesis is concerned with the use of a work in tangible and intangible form, details the individual types of exploitation, further specifies the so-called other proprietary rights and mentions the aspect of the term of existence of proprietary copyrights. The last part of the thesis is dedicated to the instrument of licence agreement, particularly the notion itself, its requisites and the licence fee, individual types of licences and facts causing expiry of a licence. The author of the thesis provides practical examples in each chapter, i.e. the case-law and related articles published in professional magazines. The case-law referred to in the thesis clearly shows that there are various approaches in the decision-making of courts and different approaches to the individual instruments. The conclusion provides recapitulation of the thesis with reference to the recent decision of the Constitutional Court which provided an incentive to examine compliance of the existing national provisions with the provisions of the EU.
