Fraudulent conducts and the role of whistleblowing in their detection

Abstract:

Diplomová práce se zabývá problematikou podvodných jednání a whistleblowingu. Cílem práce je provést analýzu vybraných případů whistleblowingu a identifikovat jejich shodné a rozdílné znaky. Práce je rozdělena do dvou částí, teoretické a praktické. Teoretická část se nejprve zaměřuje na vymezení základních pojmů. Následuje širší obecná charakteristika podvodných jednání, včetně vývoje jejich legislativní úpravy, podrobně jsou také popsány jednotlivé kategorie podvodných jednání v klasifikaci na vnější a vnitřní. Pozornost je dále věnována pachateli, prevenci a metodám odhalování vnitřních podvodů, z nich zejména whistleblowingu. Praktická část obsahuje detailní kvalitativní rozbor jedenácti kazuistik zahraničních i českých whistleblowerů s důrazem na akt ohlášení a jeho okolnosti. Kromě ekonomických kauz zahrnuje také kauzy ostatní. Těžiště spočívá v interpretaci a vzájemném porovnání případů.

Abstract:

Master's thesis deals with fraudulent conducts and whistleblowing. Its goal is to perform an analysis of chosen whistleblowing cases and to identify their identical and different characters. The thesis is divided into two parts, theoretical and practical. Theoretical part first focuses on the definition of basic terms. After that follows a broader general characteristic of fraudulent activities, including the development of their legislation, the categories of fraudulent conducts in the classification of external and internal are described in more details too. Attention is further dedicated to the perpetrator, prevention and methods of detecting internal frauds, of these particularly to whistleblowing. Practical part contains detailed qualitative analysis of eleven case studies of both foreign and Czech whistleblowers with an emphasis on the act of reporting and its circumstances. Apart from economic cases includes other cases too. The focus is on interpretation and mutual cases comparison.
