Enforcement of EU Law Against Member States through Fines Imposed by the EU Court of Justice

Abstract:

Tato práce se zabývá fungováním a efektivitou řízení o porušení povinnosti dle čl. 258-260 Smlouvy o fungování Evropské unie. Komise má široce koncipovanou pravomoc zahájit řízení o porušení proti členským státům, pokud se domnívá, že porušili své povinnosti vyplývající z práva EU. Mechanismus vynucování práva EU cestou finančních sankcí upravený v čl. 260 umožňuje Komisi podat návrh k ESD na uložení periodického penále nebo paušální částky členskému státu, který se nepodrobil původnímu rozsudku deklarujícímu porušení. Cílem této práce je popsat řízení o porušení spolu se změnami, které zavedla Lisabonská smlouva, a zhodnotit jeho současnou efektivitu. Práce zahrnuje přehled relevantní judikatury ESD stejně jako analýzu problematických aspektů řízení a návrhy na možná zlepšení.

Abstract:

This thesis deals with functioning and effectiveness of the infringement procedure under Art 258-260 of the Treaty on the Functioning of the European Union. The Commission has broad power to bring enforcement proceedings against Member States which it considers to be in breach of their obligations under EU law. The pecuniary penalty mechanism of the Art 260 allows the Commission to request the ECJ to impose a penalty payment or a lump sum on a Member State which has failed to comply with a previous judgment declaring the infringement. The aim of this thesis is to describe the enforcement procedure with the changes introduced by the Lisbon Treaty and to evaluate its current effectiveness. The case law so far will be presented in detail as well as the analysis of the problematic aspects of the procedure together with suggestions for possible improvements.
