Militant democracy - Dissolution of the Political Parties in the Czech Republic in comparison with the selected European states

Abstract:

Diplomová práce se zabývá tématem obranyschopná demokracie ? rozpuštění politických stran v České republice v komparaci s vybranými evropskými státy. V Úvodní části se práce zabývá pojmem a právním vymezením politické strany. V návaznosti na základní vymezení politické strany jsou v práci rozebrány strany antidemokratické. Extrémistické strany mohou představovat závažnou hrozbu pro demokratické zřízení. Koncept obranyschopné demokracie, poskytuje státům možnost se právními prostředky bránit, proti těm stranám, jež usilují o její rozklad, a to i za cenu omezení některých základních lidských práv a svobod. Tento model je využíván českými i zahraničními soudy i judikaturou Evropského soudu pro lidská práva. V další kapitole je rozebrána situace v České republice. Nejprve je pozornost zaměřena na rozpuštění politických stran v období první Československé republiky. Dále se práce zabývá rozpuštěním, pozastavením činnosti a odmítnutím registrace politické strany. Zákonem stanovené důvody pro rozpuštění politické strany jsou aplikovány na konkrétní případy. Rozpuštění Dělnické strany je prozatím prvním případem rozpuštěné politické strany z důvodu její nedemokratičnosti. V souvislosti s rozpuštěním Dělnické strany se znovu otevírají diskuse o možném pozastavení činnosti Komunistické strany Čech a Moravy. Práce obsahuje zamyšlení nad současnou situací, zda by případné podání návrhu na rozpuštění Komunistické strany Čech a Moravy mělo šanci na úspěch. V posledních dvou kapitolách se práce věnuje komparaci se zahraničím. Nejprve se zaměřuji na vnitrostátní právní úpravu a soudní judikaturu Německa, Španělska a Bulharska. V kapitole následující pak judikaturou Evropského soudu pro lidská práva. Uvádím základní rozhodovací principy a klíčové kauzy v judikatuře Evropského soudu pro lidská práva. Analyzovány jsou případy rozpuštění tureckých, španělských a bulharských stran.

Abstract:

This thesis deals with the topic of militant democracy ? dissolusion of the political parties in the Czech Republic in comparison with the selected European states. The introductory chapter concerns the legal concept and definitoin of a political party. After the basic determination of a political party, the thesis continues with the analysis of an anti-democratic party. The extremist parties might pose a serious threat to the democratic system. It is, therefore, important to consider the question of defending the democratic system from the attacks of anti-democratic powers. The concept of militant democracy provides the possibilities for the states to legally resist the parties that endevour to disintegrate the democracy, even if it means to restrict some of the fundamental human rights and basic freedoms. The next chapter is concerned with the situation in the Czech Republic. The means of defence, such as dissolusion, activity constraint and refusal of registration of a political party, are introduced afterwards. The process and the statutory reasons essential for the dissolution of a political party are described in this part. Subsequently, the reasons are applied on the particular cases. The dissolution of Workers? Party has been, for the time being, the first case of a dissolution of a political party due to anti-democracy. In connection with the dissolution of Workers? Party, the discussions about possible activity constraint of Komunistická strana Čech a Moravy (Communist Party of Bohemia and Moravia) are re-introduced. The thesis contains the contemplation of the current situation, whether the potential proposal to dissolve the Communist Party of Bohemia and Moravia could be successful. The last two chapters introduce the comparison with the foreign countries. At first, it is focused on the domestic law and the practice of courts in Germany, Spain and Bulgaria. The European Court of Human rights investigates whether the states' interventions to the laws embodied by the European Convention of Human Rights were legitimate. This chapter contains the basic principles of decision and the crucial cases in the practice of the European Court of Human Rights. The cases of Turkish, Spanish and Bulgarian parties are analysed.
