Public Defender of Rights in the Slovak Republic

Abstract:

The aim of my bachelor work is an attempt to give further information on the institute of Public Defender of Rights in the legal system of the Slovak Republic.In the introduction of this work I refer to the historical development and establishment of the ombudsman institute within international context, its classification, different models, relations of European ombudsman and the organs of European union with regard to international agreements, concerning the protection of human rights and liberty.The essence of this work consists of legal regulation of the institute of Public Defender of Rights (Act Nr. 564/2001 in Collection of Acts about Public Defender of Rights, in accordance with later provisions), the specialized, organizational and technical guarantee of activity of Public Defender of Rights. In this part of the bachelor work I point out the legal powers and the most frequent suggesstions of citizens and legal persons with the possibilities of their solution.In the conclusion of the bachelor work is presented an international cooperation of Public Defender of Rights, the given aims of Public Defender of Rights in the Slovak Republic within international cooperation, the importance of „children´s ombudsman” and the prospectives of activity of Public Defender of Rights in the Slovak Republic for its second function period (2007 – 2012).

Abstract:

Cieľom mojej bakalárskej práce je priblížiť a poukázať na význam inštitútu verejného ochrancu práv v právnom systéme Slovenskej republiky. V úvode práce som poukázal na historický vývoj a vznik inštitútu ombudsmana v medzinárodnom poňatí, jeho klasifikáciu, rôzne modely, vzťah Európskeho ombudsmana a orgánov Európskej únie v súvislosti na medzinárodné dohovory, ktoré sa týkajú ochrany ľudských práv a slobôd. Jadro práce pozostáva z právnej úpravy inštitútu verejného ochrancu práv (zákon č. 564/2001 Z.z. o verejnom ochrancovi práv v znení neskorších predpisov), odborného, organizačného a technického zabezpečenia činnosti verejného ochrancu práv. V tejto časti bakalárskej práce poukazujem tiež na právomoci a najčastejšie sa vyskytujúce podnety občanov a právnických osôb s možnosťami ich riešenia. V závere bakalárskej práce som uviedol medzinárodnú spoluprácu verejných ochrancov práv, vytýčené ciele verejného ochrancu práv Slovenskej republiky v rámci medzinárodnej spolupráce, význam úlohy „detských ombudsmanov“ a perspektívy činnosti verejného ochrancu práv v Slovenskej republike na jeho druhé funkčné obdobie (2007 – 2012).
