Abstract:

PANCÁKOVÁ, Katarína: Proceedings at the General court of SR versus the proceedings at the Court of Arbitration of SR. [Bachelor thesis]. Bankovní institut vysoká škola Praha, zahraničná vysoká škola Banská Bystrica. Department of economics, pricing, social sciences and law. Thesis supervisor: JUDr. Zlatica Tureková. Year of the thesis defence: 2013. Number of pages: 65 The bachelor thesis deals with the proceedings at the Court of arbitration as alternative dispute resolutions, highlighting the differences arising from the proceedings at the General court and the Court of Arbitration or arbiter. The first chapter focuses on the theoretical definition of the Court of Arbitration, its history, sources and forms of action. It is about arbitrability, the appointment of judges and arbiters. The second chapter analyzes the proceedings at the General Court of SR and the Court of Arbitration of SR, focusing the differences in the process of dispute resolution. It is also aware of the court fees as the part of the costs of proceedings. It also covers the protection of consumer rights. The third chapter provides an overview of the principles of action and the resulting benefits or disadvantages for both the plaintiff and prosecuted in the proceedings at the Court of arbitration.

PANCÁKOVÁ, Katarína: Konanie na všeobecnom súde SR verzus konanie na rozhodcovskom súde SR. [Bakalárska práca]. Bankovní institut vysoká škola Praha, zahraničná vysoká škola Banská Bystrica. Katedra ekonómie, oceňovania, spoločenských vied a práva. Vedúci práce: JUDr. Zlatica Tureková. Rok obhajoby: 2013. Počet strán: 65 Bakalárska práca sa zaoberá konaním na rozhodcovskom súde ako alternatívnym riešením súdnych sporov, s poukázaním na rozdiely vyplývajúce z konania na všeobecnom súde a stálom rozhodcovskom súde, resp. pred rozhodcom. Prvá kapitola je zameraná na teoretické vymedzenie pojmu rozhodcovský súd, jeho históriu, pramene a formy konania. Venuje sa arbitrabilite, ustanovovaniu sudcov a rozhodcov. Druhá kapitola analyzuje konanie na všeobecnom súde SR a rozhodcovskom súde SR, a poukazuje na rozdiely v procese riešenia sporu. Neopomína ani súdne poplatky ako súčasť trov konania. Zameriava sa tiež na ochranu práv spotrebiteľa. Tretia kapitola prináša prehľad zásad konania a z nich vyplývajúce výhody, resp. nevýhody pre navrhovateľa aj odporcu v prípade konania na rozhodcovskom súde.
