The U.S.A. and the International Criminal Court

Abstract:

Závěrečná práce USA a Mezinárodní trestní soud zpracovává problematiku postoje vlády USA k Mezinárodnímu trestnímu soudu, stálé instituci, která má pravomoc vyšetřovat a stíhat nejvážnější zločiny podle mezinárodního práva. USA byly jednou ze sedmi zemí, která hlasovala proti Římskému Statutu Mezinárodního trestního soudu. Cílem práce je zjistit, který politický aktér je zodpovědný za formování přístupu USA k Mezinárodnímu trestnímu soudu a určit hlavní důvody amerického negativního postoje. USA se cíleně snažily o zablokování jurisdikce Soudu vůči americkým občanům přijetím zákona o ochraně amerických občanů v roce 2002, podpisem bilaterálních dohod o nevydávání občanů USA Soudu a přijetím rezolucí Rady bezpečnosti OSN. Jádro amerických obav se váže k možnosti Soudu vést politicky motivovaná vyšetřování a stíhání proti vojenským důstojníkům a politickým činitelům USA. Z mého hlediska je podstatou obav USA možnost budoucího vyšetřování a stíhání zločinu agrese, což by mělo výrazný vliv na americkou zahraniční politiku a v důsledku i na postavení USA v mezinárodním systému.

Abstract:

The final work The United States of America and the International Criminal Court deals with the approach of the Government of the United States to the International Criminal Court, a permanent institution which has the power to exercise its jurisdiction over persons for the most serious crimes of international concern. The United States was one of seven countries that voted against the Rome Statute of the International Criminal Court. The aim of this work was to find out which actor of the political system was responsible for shaping the US attitude towards ICC and determine main reasons of the american hostility to the Court. USA purposely tried to restrain the jurisdiction of the Court over U.S. citizens by adopting American Servicemembers Protection Act in 2002, by signing Bilateral Impunity Agreements with states all over the world and by adopting Security Council Resolutions. The merit of the U.S. concern relates to the prospect that the ICC may exercise its jurisdiction to conduct politically motivated investigations and prosecutions of U.S. military and political officials and personnel. In my view the principle concern of US government is the future possibility of investigation and prosecution of the crimes of aggression by the Court what would significantly influence american foreign policy and in consequence its position in the international system.
