The influence of the Universal Periodic Review on the observance of human rights in countries that use the death penalty

Abstract:

Univerzální periodický přezkum (Universal Periodic Review, UPR) představuje jedinečný kontrolní mechanismus, který probíhá pod záštitou Organizace spojených národů (OSN). UPR kontroluje dodržování lidských práv ve všech členských zemích OSN. Na porušování lidských práv je upozorňováno v souvislosti s používáním trestu smrti. Trest smrti není vždy v zemích udělován v souladu s mezinárodními normami. Mezi nejdůležitější mezinárodní dokumenty, které upravují použití trestu smrti, patří Mezinárodní pakt o občanských a politických právech a Druhý opční protokol k Mezinárodnímu paktu o občanských a politických právech. Cílem bakalářské práce je zjistit, jaký vliv má UPR ve vybraných islámských zemích, které trest smrti používají, a zda tento přezkum přispívá ke zrušení trestu smrti a dodržování lidských práv v těchto zemích. V bakalářské práci jsou zanalyzována první a druhá kola UPR. Obzvláště je pozornost věnována doporučením, která byla v obou kolech udělena, a tomu, zda byla tato doporučení přijata. Pro empirickou část práce byly vybrány země Irák, Írán, Omán, Saúdská Arábie, Spojené arabské emiráty a Súdán.

Abstract:

The Universal Periodic Review (UPR) is a unique mechanism, which is conducted by the United Nations. UPR controls the observance of Human Rights in all UN member states. A violation of human rights is connected with the use of the death penalty. The death penalty is not always imposed in accordance with international norms. The most important international documents, which regulate the use of the death penalty, are International Covenant on Civil and Political Rights and Second Optional Protocol to the International Covenant on Civil and Political Rights. The bachelor thesis aims to find out how the UPR can influence the selected Islamic countries, which impose the death penalty, and find out whether this mechanism contributes to abolish the death penalty and improve the protection of the human rights in these countries. The first cycle and second cycle of the UPR were evaluated in the bachelor thesis. Attention is focused chiefly on the recommendations, which were given, and which of them were accepted. Iraq, Iran, Oman, Saudi Arabia, United Arab Emirates, and Sudan were selected for the empirical part.
