Impact of Various Obligation Regimes on the Contractual Penalty
Abstract:
Ve své diplomové práci jsem se zaměřil na úpravu a smluvní dispozitivní možnosti smluvní pokuty v závislosti na charakteristice režimu závazkového vztahu z hlediska jeho subjektového složení, včetně vztahů smíšených, v režimu ObchZ, kde se zaměřením především na dopad ustanovení § 262 odst. 4 obchodního zákoníku a sporné otázky, které jsou s jeho interpretací spojeny.
