Early dissolution of Parliaments and the case of Czech Republic

Abstract:

Předkládaná diplomová práce vytváří na základě dostupné literatury pracovní klasifikaci základních mechanismů předčasného rozpuštění parlamentu. Na základě analýzy několika vybraných evropských zemí poukazuje na odlišnosti mezi ústavním nastavením i reálným fungováním. Analyzované země jsou zároveň, na základě využívaného mechanismu předčasného rozpuštění, zařazeny do jednotlivých kategorií pracovní klasifikace. Tato práce rovněž popisuje vývoj českého mechanismu rozpuštění Parlamentu, a to od roku 1920 do současnosti. Jednotlivé etapy vývoje jsou přiřazeny taktéž ke kategoriím pracovní klasifikace. Na základě poznatků získaných studiem evropských zemí a historie vývoje mechanismu v České republice navrhuji úpravu současného nastavení předčasného rozpuštění Poslanecké sněmovny PČR s přihlédnutím k širšímu kontextu politické kultury v ČR.

Abstract:

This thesis, which was written on the base of the accessible literature, creates working classification of the main mechanisms by which Parliaments can be dissolved early. On the base of analysis several selected European countries, this thesis highlights the differences between the constitutional adjustment and practical application of this mechanism. Countries analyzed in this thesis are also matched to the categories of the classification on the base of used mechanism by which Parliament of the country can be dissolved early. This thesis includes also description of the evolution of the Czech mechanism, namely from year 1920 to contemporary adjustment. On the base of knowledge gained through examining of the selected European countries and studying adjustment of the mechanism of early dissolution in Czech Republic, I suggest appropriate modifications in the adjustment of the mechanism by which the Chamber of Deputies of the Parliament of the Czech Republic can be dissolved early. The proposed modifications are also reflecting the specific context of political culture in the Czech Republic.
