Práce je rozčleněna na několik částí, z nichž první dvě uvádějí nezorientovaného čtenáře do problematiky stručným objasněním historického kontextu vývinu žaloby na obnovu řízení a žaloby pro zmatečnost. V v stěžejní části práce rozebírá základní prvky obou výše uvedených žalob jako například předmět, důvody použití, lhůty atd. s důrazem na jejich vzájemnou komparaci.
