Craft Enterprise License in the Czech Republic and in some Selected States of the European Union

Abstract:

Anotace Pi vytváení základních komponent prosperity spolenosti sehrává živnostenská výroba významnou roli, zpsobenou primárn skuteností, že živnostenské podniky jsou schopny poskytnout živobytí nejširším vrstvám spolenosti. Rozvoj malého a stedního podnikání je dležitým ekonomickým faktorem, kterou realizovala i eská republika. Poslední období v Evrop, ale podobn i v našich regionech, je charakterizované peshraniní spoluprácí. Budování teoretického a metodologického základu je aktuální výzvou pro teoretické právní vdy, po právní praxi a též legislativu, což v pepojení na komparatistický pohled zkoumání je schopen poskytnout nové pohledy. Z uvedených dvod se pokusí disertaní práce o charakteristiku živnostenského práva v sousedních regiónech Moravy, primárn tedy v eské republice, ale také na Slovensku, v Maarsku a v Rakousku. Cílem a pedmtem zkoumání práce jsou právní záležitosti eské, zahrnující popis aktuálního právního stavu, nicmén je tady pokus o podání nového pohledu, dáno komparativním charakterem. Základem práce je jazyk, terminologie a právo eské. Z pohledu obecného, odvozené od úpravy eské, jsou pak charakterizované rozdílnosti Slovenské, Maarské a Rakouské úpravy. Samotná systematika práce je odlišná od obvyklého komentáového znní. Jednotlivé ásti práce jsou azeny pedevším z hlediska obsahové konzistence. Tak je práce rozdlena mimo úvodu a závru do osmi následujících ástí: - základní pojmy, - prameny práva živnostenského, - živnostenské právo v systému práva, - vymezení živnostenského podnikání, - subjekty živnostenského práva a živnostenskoprávních vztah, - vznik oprávnní k živnostenskému podnikání, - realizace a kontrola živnostenského oprávnní, - zmna a zánik živnostenského oprávnní. Pestože východiska jednotlivých právních ád jsou místy stejná, jejich rozdíly popít nelze. Vnjším projevem jsou rozdílnosti jednotlivých právních pravidel, odlišné právní formulace nebo odlišná právní síla norem apod. Tyto skutenosti však mnohdy nevystihují podstatu, neboli skutený vnitní smysl rozdílnosti jednotlivých právních ád, které lze spoznat prostednictvím komplexního pohledu na daný pojem (institut). To znamená, že ke skutenému obsahu konkrétního právního výrazu lze dospt výhradn skrze široké vnímání dané skutenosti, která spoívá pedevším v pihlédnutí k základním znakm všeobecného systému.Takové poznání je však primárn stžena jazykovou barierou mezi jednotlivými právními ády. astým jevem je napíklad odlišný obsahový význam gramaticky (jazykov) totožných pojm. Hlavním pedmtem zkoumání práce je eský právní ád, lépe eeno eská úprava živnostenského práva v porovnání geograficky nejbližších Evropských región. Navazující na uvedené, je uinno úsilí o peklad nikoliv gramatický, nýbrž obsahový. Disertaní práce se snaží být takovým výkladem, prostednictvím kterého (znovu)studium práva živnostenského nebude pedstavovat cizí a tžkou záležitost pro eského tenáe.

Abstract:

Annotation In the process of creating the basic ingredients of the wealth of a society the importance of craft industries is quite high, primary caused by the facts, that craft industries are able to provide wealth for the widest parts of the society. The development of small and medium sized enterprises is a respectable economic factor, which importance is recognized by the Czech Republic as well. The recent time period in Europe and also in Central Europe has been characterized by a cross-border co-work. The building of a theoretical and methodological basis is an actual call for the theoretical law sciences, for the legal praxis and legislation, which in a connection with a comparatistic view, can provide new point of views. Therefore the dissertation work attempts to characterize the legal basis of craft industries in near-Moravian regions, primary in the Czech Republic but also in Slovakia, Hungary and Austria. The primary aim and subject of the work are Czech legal issues, by providing an actual description of the Czech legal matters in this subject, while there is an effort to deal with this subject from a new point of view, granted by its comparative character. The basic of it is the Czech language, legal terminology and law. From general point of views, derived from the Czech regulation, are characterized the individual differences among Slovak, Hungarian and Austrian regulations. The structure of the work is different from the classical commentary style and does not follow the order of the paragraphs. The individual parts are consistent in their subjects. In this way, the work is divided to these parts: - basic concepts and terms, - sources of law, - the crafts regulation in the law system, - definition of craft and craft enterprises, - establishment of the title of enterprising to crafts, - realization of the craft and the state control, - changes and contingent termination of a business license. Despite the fact, that the basic principles of the individual legal systems are similar, the differences can be seen immediately, in form of different grammatical formulations, hierarchization of sources of law, etc. But these external inconsistencies do not reflect always the inner individualism of legal systems, so if there is a need for full understanding of a legal institution, it can be achieved by complex examination. In simpler terms it means, that to understand a foreign legal concept in its every aspect assumes the understanding of the basic principles and ideas of the foreign law system as a whole. Such understanding is made difficult primary by a language barrier. For example the different meaning of grammatically identical terms is a common phenomenon. Because of this, essays conversant with legal comparatism needs to define a resource legal system, where its language, terms and legal institutions will serve as a instrument of interpretation for the other legal regulations. The dissertations starting and finishing point is the Czech legal system, specifically the Czech regulation of the craft enterprises compared to the geographically nearest European regions. According to the above mentioned, in a such essay there is a need of translation of concepts as whole, not only simple translation of words. The dissertation work tries to offer exactly this kind of commentary, by means of which the (re)studying will not be an alien and elusive task for the Czech readers.
