The Competence of the Czech Customs Administration in the Field of Investigation

Abstract:

Tématem diplomové práce je působnost Celní správy České republiky v oblasti pátrání z důvodu mého působení v této oblasti. Cílem práce je identifikovat a objasnit kompetence v trestněprávní oblasti Celní správy České republikya jejich rozšířenía dále charakterizovat činnost útvarů pátrání, která je vykonávána v souladu se zákonem. Přínos diplomové práce vidím v tom, že je nahlédnuto do práce tzv. „pátračů“, která veřejnosti není příliš známá a možnosti, které tito příslušníci mají v oblasti trestně právní. Práce se zabývá potencionálností dalšíhorozšíření kompetencí celníků,a popisuje eventualitu vzniklých problémů. V neposlední řadě jsou uvedeny reálné případy páchané trestné činnosti.

Abstract:

This diploma thesis analyses the competence of the Czech Customs Administration in the field of investigation based on my own knowledge and experience. The objective of the thesis is to characterize and sufficiently clarify the competences of the Czech Customs Administration in criminal matters and their extension. Furthermore, it describes the activities of investigation units performed in compliance with the law. The main contribution of the thesis is, in my opinion, that it gives the readeran in sight into the work of the so-called "detectives", which the public is not much familiar with, and into the options offered to the officials in criminal matters. The thesis analyses the potential extension of customs officers' competences and describes the contingent problems. Italsointroducessomerealcasesofcrimescommitted in thisfield.
