The Specifics of Financial Arbitration

Abstract:

Diplomová práce se zabývá charakteristikou vlastního řízení před finančním arbitrem, otázkou jeho rozhodovací pravomoci a problematikou soudního přezkumu jeho rozhodnutí. Text je členěn do tří částí. První část je věnována charakteristice vysvětlení základních pojmů souvisejících s finanční arbitráží a systematikou právní úpravy. V druhé části se zabývám vymezení okruhu sporů, které náleží do působnosti finančního arbitra, přičemž důraz je kladen na aktuální problémy v oblasti spotřebitelských úvěrů. V poslední části se věnuji procesní úpravě finanční arbitráže. Jsou zde uvedena specifika řízení před finančním arbitrem, vybrané rozdíly mezi rozhodčím řízením a řízením před finančním arbitrem a tato část je završena řešením problematiky přezkumu rozhodnutí finančního arbitra. Otázka přezkumu rozhodnutí finančního arbitra je demonstrována na rozhodnutí Nejvyššího správního soudu, které je analyzováno metodou IRAC. V závěru práce je hodnocen model alternativního řešení sporů, který byl Českou republikou zvolen.

Abstract:

The thesis deals with characterization of the proceedings which are brought before the Financial Arbitrator, sequentially with the question of its decision-making competence and difficulty in judicial review of a decision made. It is thematically divided into three main chapters. The first chapter concentrates on the explanation of main terms, related to the financial arbitration, and the system of legal regulations. In the second chapter, I focus especially on a type of dispute specification which belong to the Financial Arbitrator’s competence, when the emphasis is placed on the current problems arising from consumer credit. The last chapter analyses procedural requirements within the financial arbitration. I have introduced the specifics of the financial arbitration and drawn distinctions between the arbitration proceedings and the proceedings brought before the Financial arbitrator. This part reaches a solution to review made by the Financial Arbitrator. The difficulty in judicial review of the Financial Arbitrator is executed through the Supreme Administrative Court’s decision, which is analyzed by IRAC method. Finally, the last part evaluates the model of alternative resolution to disputes, chosen by the Czech Republic.
