Abstract:

Tato diplomová práce se zabývá nájmem prostor sloužících k bydlení. S ohledem na požadovaný rozsah diplomové práce nebylo možné dané téma zpracovat zcela komplexně. Cílem této diplomové práce je systematicky rozebrat některé otázky právní úpravy nájmu prostor sloužících k bydlení. Diplomová práce se věnuje výkladu základních pojmu, jakými jsou například nájem a koncepce nájemného obecně, shrnuje dále podstatné náležitostí nájemní smlouvy, pojednává o právech a povinnostech smluvních stran. Práce se dále zabývá způsoby skončení nájmu těchto prostor se zaměřením na jednotlivé aspekty daných způsobů. Poměrně velká část je pak věnována institutu výpovědi z nájmu prostor sloužících k bydlení. Nakonec diplomová práce zkoumá fenomén sdílené ekonomiky na příkladu společnosti Airbnb. Původním zaměřením této kapitoly bylo nastínit, jaké příležitosti může tento fenomén poskytovat firmám a jednotlivcům a jaké změny přináší pro celou společnost. Nicméně, z důvodu výskytu pandemie Koronaviru Covid-19, od původního zaměření bylo ustoupeno ve prospěch nutnosti přesnější a přehlednější právní regulace tohoto fenoménu.

Abstract:

This diploma thesis is about lease of housing premises. With regard to the required extent of the diploma thesis, it was not possible to provide a completely comprehensive overview of this topic. The purpose of this diploma thesis is to systematically analyze the main questions of legal regulation of rent of housing premises. The diploma thesis deals with the interpretation of basic concepts, such as rent in general and its concept, summarizes the essentials of the lease, discusses the rights and obligations of the parties of the contract. The thesis also deals with different ways of termination of lease of these spaces with a focus on individual aspects of them. A relatively large part is devoted to the institute of notice of termination of the lease of housing premises. Finally, this thesis defines the phenomenon of shared economy on the example of Airbnb. The original focus of this part of diploma thesis was to demonstrate what opportunities this phenomenon can provide to companies and individuals and what changes it brings to society. However, due to the occurrence of the Coronavirus pandemic caused by Covid-19, the original focus has been abandoned with regards to point out the need for more precise and clearer regulation of phenomenon of Airbnb.
