Abstract:

České stavební právo s platností od 1.1.2007 prošlo zcela zásadní změnou v podobě přijetí nového stavebního zákona č.183/2006 Sb. Tento nový zákon založil odlišné pojetí projednávání staveb u stavebních úřadů, zavedl nové pojmy a instituty. Předmětem této práce jsem zvolila nejpoužívanější instituty, kterými je ohlašování staveb, proces stavebního povolení a povolení užívání staveb, s cílem stanovit rozdíly mezi předchozí po dlouhá léta zavedenou právní úpravou a právě tímto novým zákonem. Rozbor jednotlivých procesů povolování je proveden postupně v kapitolách s popisem pozitivních i negativních dopadů pro jednotlivé stavebníky na základě mé dlouhodobé praxe na stavebním úřadě. Po prostudování získaných materiálů, zkušeností z vlastní praxe aplikování nového stavebního zákona i praxe stavebního úřadu jako celku, jsem se snažila vyslovit svoje návrhy na možná zlepšení v připravované novele stavebního zákona.

Abstract:

The Czech construction lien has gone through a significant change since January 1st 2007 by approving of a new Building Act No. 183/2006 Digest. This new act initiated a new concept of building proceedings at Building Authority and brought new terms and institutions. My work deals with the most frequently used institutions, such as building registrations, process of building licence and licence of building uses, and aims at finding the differences between the past legal regulations that were used for decades and this new law. Further, I concern about the analysis of individual processes of approving in the chapters and describe positive and negative impacts on particular owners of the houses under constructions, all on the basis of my long-term practice at Building Authority. After reading up all the gained materials coming from my own knowledge and the application of the new Building Act and the practice of Building Authority, I tried to suggest some possible improvements for the future amendment of Building Act.
