Role of Insolvency Administrator in Process of Debt-Relief

Abstract:

Tématem této diplomové práce je problematika úlohy insolvenčního správce v oddlužení jako způsobu řešení úpadku dlužníka. Práce nejprve analyzuje pojem insolvenčního správce, jeho postavení, obecné povinnosti v insolvenčním řízení a související aspekty jeho činnosti. Poté práce obsahuje informativní kapitolu týkající se oddlužení. Závěrem se práce zaobírá chronologickým přehledem činností insolvenčního správce v celém procesu oddlužení, od jeho ustanovení do daného řízení po splnění oddlužení. V práci jsou zohledněny hlavní legislativní změny, tj. změny od 1.7.2017 a 1.6.2019, které měly velký dopad na tuto právní úpravu. Cílem práce je analyzovat postavení insolvenčního správce v insolvenčním řízení, podat ucelený přehled jeho činností a povinností v oddlužení s důrazem na problematická místa této úpravy.

Abstract:

The topic of this diploma thesis is the issue of the role of the insolvency administrator in debt relief as a way of solving the debtor's bankruptcy. The thesis first analyzes the concept of insolvency administrator, his position, general obligations in insolvency proceedings and related aspects of his activities. Then the thesis contains an informative chapter about debt relief. Finally, the work deals with a chronological overview of the activities of the insolvency administrator in the entire process of debt relief, from its appointment to the proceedings to the fulfillment of debt relief. The work takes into account the main legislative changes, ie changes from 1.7.2017 and 1.6.2019, which had a major impact on this legislation. The aim of the thesis is to analyze the position of the insolvency administrator in insolvency proceedings, to give a comprehensive overview of his activities and obligations in debt relief with emphasis on the problematic areas of this regulation.
