Law and Cybersecurity of the Czech Republic

Abstract:

Narůstající závislost nejen soukromých subjektů, ale též orgánů veřejné moci na informačních technologiích staví do popředí naléhavou otázku zabezpečení fyzické informační infrastruktury a uložených, často velmi citlivých dat. Práce analyzuje pojem kybernetické bezpečnosti jak z hlediska technického (aktuálních hrozeb a možností zabezpečení), tak z hlediska právního, přičemž důraz je kladen na připravovaný Zákon České republiky o kybernetické bezpečnosti a dosah jurisdikce správních a soudních orgánů České republiky v prostředí informačních sítí (kyberprostoru). Práce se zabývá též fenomény úzce souvisejícími, konkrétně kybernetickým terorismem, právní odpovědností poskytovatelů služeb informační společno- sti (ISP) a hodnocením přeshraničních kybernetických útoků z pohledu mezinárodního práva (veřejného). Mimo rozsah práce naopak zůstávají např. otázky mezinárodního práva soukromého na internetu, kyberkriminality a patologických sociálních jevů v prostředí informačních sítí.

Abstract:

Law and Cybersecurity of the Czech Republic (Master Thesis) addresses an urging question of security of IT infrastructure and (in some cases very sensitive) data stored in the Czech Republic, given the rising dependence of both private and public entities on IT resources and tools. The thesis analyzes the term „cybersecurity“ from both technical (current threats and countermeasures available) and legal point of view. In the latter emphasis is put on Czech Republic Draft Bill on Cybersecurity and a scope of jurisdiction of Czech courts and administrative bodies in cyberspace. The thesis also briefly examines some related topics, particularly cyberterrorism, legal liability of Information Services Providers (ISPs) and assessment of cross-border cyberattacks under current international (public) law. On the other hand, from the scope of the thesis are excluded, but for possible exceptional remarks, topics of international private law in cyberspace, cybercrime and misbehaviour in cyberspace. The language of the thesis is Czech.
