Abstract:

Hlavním cílem diplomové práce na téma "Mimosoudní řešení majetkových sporů" byla lepší orientace ve způsobech řešení mimosoudních sporů, klady a zápory jednotlivých způsobů a přiblížení celkové funkce ADR. Práce věnuje velkou pozornost institucím, které se zabývají danou problematikou a posuzováním různých nálezů těchto institucí. Pomocí zpracování těchto nálezů byly zjištěny nejčastější chyby a problémy při uzavírání smluv a rozhodčích doložek, kterých se obě strany dopouštěly a ze kterých se poté stávala často i vleklá mimosoudní, ale i soudní, jednání. V praktické části jsou jmenovány určité instituce, které se mimosoudním řešením sporů zabývají a to jak u nás, tak v zahraničí. V závěru práce je možné se seznámit s výsledky, které byly vypozorovány pomocí jmenovaných prostředků.

Abstract:

The main aim of the thesis "Out-of-court Settlements of Property Disputes" was better orientation in the ways of solving out-of-court dispute resolution, pros and cons of various approaches and overall function of ADR. The thesis pays great attention to institutions dealing with the issues and assessing the various findings of these institutions. Using the processing of these findings the most common mistakes and problems in closing contracts and arbitration, which both parties committed, were detected and which then became frequent in out-of-court settlements but also in judicial clauses,. In the practical part some institutions are named and these institutions deal with out-of-court settlements in the Czech Republic and also abroad. At the end of the thesis it is possible to get acquainted with the results, which were inferred from appointed tools.
