Dimensions of International and European Energy Law: State Sovereignty in Ensuring Energy Security

Abstract:

Předmětem této disertace je analýza role státní suverenity při zajišťování energetické bezpečnosti. První část práce pojednává o úloze státu a jeho vztahu k přírodnímu bohatství. V druhé části autor představuje základní koncepty energetické bezpečnosti a popisuje energetický mix a klíčové strategické dokumenty České republiky. Třetí část práce tvoří právně-teoretická analýza konceptu suverenity, a principu trvalé svrchovanosti nad přírodním bohatstvím. Jádrem práce je rozbor jednotlivých nástrojů energetické bezpečnosti, vycházejících jak z vnitřní, tak vnější suverenity a jejich kompatibilita s mezinárodněprávními závazky státu. Tato analýza má za cíl vymezit, jak široký regulatorní prostor ČR při zajišťování energetické bezpečnosti má. Práce rozlišuje nejrůznější režimy od přímé kontroly energetického sektoru státem, až po koncepci postavenou na liberalizaci energetického trhu, kdy se stát přesunul pouze do pozice regulátora. Autor analyzuje napětí mezi státní suverenitou na jedné straně a mezinárodními závazky, kterými je stát vázán v oblastech ochrany lidských práv, mezinárodního investičního práva a mezinárodního obchodního práva, na straně druhé. Poslední část práce je věnována vnější dimenzi energetické bezpečnosti. Autor na základě rizik, kterým jsou dodávky energií vystaveny, identifikuje klíčové nástroje mezinárodního práva a modality suverenity s tím spojené.

Abstract:

This dissertation explores a dynamic relationship between state sovereignty and energy security. The first chapter is focused on the role of a state in ensuring its energy security. The second chapter introduces different concepts of energy security and identifies key challenges to be addressed by the Czech Republic. The third chapter deals with the concept of state sovereignty and its different dimensions as well as the permanent sovereignty over natural resources. The fourth chapter deals with different tools of national and international law designed to enhance energy security. Special focus is given to the regulatory power of a state while facing energy security challenges. This part reveals an inherent tension between various international obligations and domestic measures taken in order to enhance energy security. An analysis covers both liberalized energy market and markets controlled by a state. The dissertation explores limitations imposed on a state sovereignty via international law including international human rights law, international economic law and international investment law. The last chapter is focused exclusively on external tools of energy security. Modalities of state sovereignty as well as particular examples of the international cooperation are examined, including NATO, IEA, IMF, The Energy Charter Treaty and the European Union.
