Impacts of laws prohibiting discrimination between men and women on the insurance products

Abstract:

Diplomová práce se zabývá problematikou zákazu diskriminace mužů a žen v pojišťovnictví, kterou přineslo rozhodnutí Soudního dvora Evropské unie v březnu roku 2011. Rozhodnutí je platné od 21. 12. 2012 a je upraveno Směrnicí 2004/113/ES zavádějící zásadu rovného zacházení s muži a ženami v přístupu ke zboží a službám a jejich poskytování. Směrnice byla vydána k 13. 12. 2004 a na pojišťovnictví se v původní verzi vztahovala výjimka. Ta byla ale rozhodnutím Soudního dvora EU zrušena, a to na základě případu Test-Achats. Pojišťovny členských států Evropské unie proto musely zavést jednotné sazby pojistného a pojistného plnění pro muže a ženy. Práce tedy podrobněji rozvádí, jak evropskou právní úpravu, tak i proces řízení ve věci Test-Achats. Hlavním tématem práce je nicméně životní pojištění, jeho produkty a způsob kalkulace pojistného, a to především z pohledu změn, které zmíněná Směrnice EU přinesla. Práce hodnotí, jak se změnily ceny, poptávka a samotná produktová nabídka životního pojištění. S tím souvisí také otázka, zda tyto změny byly pozitivní nebo negativní, na které práce také hledá odpovědi. Nemalá pozornost je proto soustředěna také statistickým údajům souvisejícím s genderovou tématikou. Ty totiž dokládají, že dříve hojně využívané rozlišování pohlaví při stanovení ceny pojištění a pojistného plnění mělo své opodstatnění.

Abstract:

This MA thesis deals with the issue of the ban on discrimination of men and women in the insurance business, which was brought about by the decision of the EU Court of Justice in March 2011. The decision came into effect on 21 December 2012 and is modified by the 2004/113/ES regulation, which introduced the principle of equal treatment of men and women with regard to both the access to goods and services and the administration thereof. The regulation was issued on 13 December 2004 and the whole of insurance industry was initially exempt from it. However, with reference to Test-Achats case, this regulation was nullified by the EU Court of Justice. Insurance companies in all the EU member states therefore needed to introduce uniform insurance rates and insurance benefits rates for men and women. The thesis thus elaborates in some detail both on the European legal adjustment, and on the Test-Achats case. Nevertheless, the main focus of this thesis lies on the issue of life insurance – its products and methods of rate calculations – perceived primarily from the point of view of the changes brought about by the new EU regulation. The thesis evaluates the changes in prices, demand, and offer of life insurances. Whether these changes were positive or negative is a question which goes hand in hand with this issue, and also one of the questions to which this thesis attempts to find some answers. Significant amount of attention is therefore given to statistical data related to gender issues, for these data clearly show that the gender distinction previously applied in establishing the cost of insurance and insurance benefit was not used without reason.
