UN sanctions: history and present application

Abstract:

Sankce jsou hlavním nástrojem Rady bezpečnosti OSN, který slouží k udržování mezinárodního míru a bezpečnosti. Tato práce analyzuje efektivitu tohoto významného nástroje. Během studené války byly uvaleny pouze dva sankční režimy, proti Rhodésii a Jižní Africe. V těchto případech byly uvaleny ekonomické sankce, které ale nebyly efektivní, protože vlády těchto států využívaly ilegálních obchodů, aby stabilizovaly státní ekonomiku. Ekonomické sankce mívají často negativní dopad na civilní obyvatelstvo. Kvůli tomuto problému byly zavedeny chytré sankce. Chytré sankce jsou cílené hlavně na vlády sankciovaných států, nebo na jednotlivce. Dopad chytrých sankcí na civilní obyvatelstvo je minimální. Chytré sankce jsou také více efektivní, než plošné sankce. Spousta sankčních režimů nebývá efektivní. Sankce jsou efektivní v případě, že dojde k naplnění cílů určených rezolucí Rady bezpečnosti OSN. Cíl obsažený v rezolucích Rady bezpečnosti byl naplněn pouze v případě Libye (hovoříme-li o sankcích uvedených v této práci). Cíl byl naplněn z toho důvodu, že libyjská vláda přerušila veškeré vztahy s teroristy a poskytla kompenzaci státům, které se staly obětmi teroristických útoků vedených Libyí.

Abstract:

Sanction regime is the main instrument of UN Security Council to preserve international peace and security. This text analysis effectiveness of this important instrument. There was only two sanction regimes used during the Cold War, against Rhodesia and South Africa. In these cases there were used economic sanctions which were not effective because governments of these countries used illegal trade for stability of the state economy. Economic sanctions had mostly bad impact on civilians. Because of this problem were introduced smart sanctions. Smart sanctions are targeted at the government of sanctioned state, or individuals. Impact of smart sanctions on civilians is minimal. Smart sanctions are also more effective than all-state sanctions. A lot of sanction regimes is not effective. Sanction regime is effective when are fulfilled purposes which are inherent in the resolution of UN Security Council. The purpose inherent in resolution of UN Security Council was fulfilled only in case of Libya (of analyzed sanction regimes in this text). It was because of the Libyan government ended relationships with terrorists and compensated losses to states where they were committed terrorist attacks.
