Illegal erterprise, its legal consequences an Impact on the Validity of Contract

Abstract:

This bachelor thesis is focused on the offense of unauthorized business, which is classified as crimes endangering market economy, put in the first parts of Title Special Part of the Criminal Code, entitled Economic Offences. The first chapter describes the general theoretical basis for business. The second chapter analyzes the legal consequences of unauthorized business in terms of economic offenses, under the Trade Act, the Social Insurance Act and the Health Insurance Act. The third part of the thesis deals with the possibilities and limitations of unauthorized business analysis checks that are carried out with a view to preventing unauthorized business.

Abstract:

Predložená bakalárska práca je zameraná na trestný čin neoprávneného podnikania, ktorý je zaradený medzi trestné činy ohrozujúce trhovú ekonomiku, upravené v prvom diely piatej hlavy osobitnej časti Trestného zákona s názvom Trestné činy hospodárske. Prvá kapitola všeobecne popisuje teoretické východiská v oblasti podnikania. V druhej kapitole sa analyzujú právne dôsledky neoprávneného podnikania z pohľadu trestných činov hospodárskych, v zmysle živnostenského zákona, zákona o sociálnom poistení a zákona o zdravotnom poistení. Tretia časť bakalárskej práce sa zaoberá možnosťami obmedzenia neoprávneného podnikania a analýzou kontrol, ktoré sú uskutočňované s úmyslom zamedzenia neoprávneného podnikania.
