Abstract:

Tato diplomová práce se zabývá tématem trestných činů proti životu. Poukazuje na skutečnost, že tyto trestné činy jsou vnímány laickou i odbornou veřejností jako nejzávažnější kriminální činy a to s ohledem na jejich následek, kterým je úmrtí člověka. V teoretické části legislativně vymezuje problematiku trestných činů proti životu, dále rozebírá a popisuje jednotlivé skutkové podstaty trestných činů, které jsou podřaditelné pod kapitolu trestných činů proti životu, provádí krátký exkurz do disciplíny soudního lékařství, jehož přinejmenším základní poznání je nezbytné pro řádné vykonávání úkonů orgánů činných v trestním řízení v řešené problematice, vysvětluje úkony prováděné orgány činnými v trestním řízení ve stadiu prověřování i ve stadiu vyšetřování k řešené problematice a konečně popisuje zahraniční zkušenosti v řešené problematice. V praktické části pak diplomová práce prostřednictvím dotazníkového šetření zkoumání současný stav poznání řešené problematiky mezi příslušníky Policie České republiky. Výsledek výzkumu poté textem i graficky prezentuje. V závěrečné části nabízí i návrhy možných změn, či úprav postupu vzdělávání policejních orgánů v řešené problematice od prvotního ohledání místa činu až po ukončení činnosti policejních orgánů.

Abstract:

This diploma thesis deals with the topic of crimes against life. Points to the fact that these crimes are perceived by the lay and professional public as the most serious criminal offenses, given their consequence, which is the death of a person. In the theoretical part, it legislatively defines the issue of crimes against life, further analyzes and describes the individual facts of crimes that are subordinate to the chapter of crimes against life, makes a short excursion into the discipline of forensic medicine, at least basic knowledge is necessary for proper performance of acts criminal proceedings in the solved issue, explains the acts performed by the bodies active in criminal proceedings in the stage of investigation and in the stage of investigation on the solved issue and finally describes the foreign experience in the solved issue. In the practical part, the diploma thesis through a questionnaire survey examines the current state of knowledge of the issues addressed among members of the Police of the Czech Republic. The diploma thesis then presents the result of the research in text and graphics. In the final part, it offers the possibility of proposals for possible changes or adjustments to the training of police authorities in the issues addressed from the initial search of the crime scene to the end of the police departments.
