Abstract:

Bakalářská práce se zabývá ochranou zvířat proti týrání v zájmových chovech v České republice. Teoretická část se věnuje analýze a hodnocení právní úpravy ochrany zvířat. Analýza se zaměřuje na tři základní oblasti, kterými jsou právní úprava na ochranu zvířat proti týrání, právní úprava dle veterinárního zákona a právní úprava dle trestního zákoníku. Velká část je věnována statusu zvířat včetně jeho zakotvení v občanském zákoníku. V této části je mimo jiné zahrnuto obecné vymezení základních pojmů, druhy a motivy týrání. Dále se teoretická část věnuje příslušným orgánům a nevládním organizacím a na závěr této části je zhodnocena platná právní úprava. Praktická část se zaměřuje na vybraný útulek, kterým je Centrum pro zvířata v nouzi v Ústí nad Labem a spadá pod Zoologickou zahradu Ústí nad Labem. Tento útulek je krátce charakterizován z hlediska jeho historie a funkce. Cílem je analyzovat provoz a povinnosti provozovatele útulku, zjistit, jakým způsobem je útulek financován a uvést konkrétní případy zvířat přijatých do útulku. Součástí je také péče o zde umístěná zvířata. Praktická část se dále zaměřuje na vnímání týrání zvířat v zájmových chovech z pohledu obyvatel Ústeckého kraje. V závěru je celkové zhodnocení aktuální podoby právní úpravy, její účinnosti a návrhy možností zvýšení ochrany zvířat v zájmových chovech.

Abstract:

The bachelor thesis deals with the protection of pets against cruelty in the Czech Republic. The theoretical part of the thesis analyses and evaluates the existing legal regulation of the animal protection. The analysis focuses on 3 areas: regulation of the Act No 246/1992 Coll., on the protection of animals against cruelty, regulation of the Act No. 166/1999 Coll., on veterinary care and on a change of some related laws and regulation of the Act No. 40/2009 Coll., Criminal Code. A large part is devoted to animal status including its position in the Civil Code. There are also basic definitions, types and motives of the abuse in this part. Then it is devoted to the competent autorithies and nongovernmental organizations. In the end there is evaluation of the regulation of animal protection. The practical part of the thesis is aimed on the selected shelter, the Centre of animals in need in Ústí nad Labem, which is led by the Zoo Ústí nad Labem. This shelter is shortly characterized in terms of its history and its function. The main goal is to analyse the operation and responsibilities of the shelter, find out how the shelter is funded and supported and describe 2 cases of animals brought into the shelter. The practical part includes the care of the animals here. The bachelors thesis is also aimed on population of Usti Region and how they perceive the pets' cruelty. In the end, there is an overall rating of the actual form of legislation, its efficiency and propose ways to increase of the protection of pets against cruelty.
