Endorsement of a Bill of Exchange

Abstract:

Autorka se v práci nejprve zabývá vymezením právní úpravy směnečného práva, vč. krátkého historického exkurzu, a také vztahem směnečného práva k jiným právním předpisům. Těžiště práce spočívá v rozboru právní úpravy směnečných způsobů převodu směnky a v jejich odlišení od převodů nesměnečných. Podstatná část práce je zaměřena na převod směnky prostřednictvím indosamentu, vč. výčtu a popisu účinků, které převod za použití rubopisu vyvolává, a také jednotlivých druhů indosamentů. Část práce je věnována praktickým důsledkům využití, ale zejména zneužití právní úpravy směnečných převodu směnky a též možnostem, které má dlužník k dispozici při snaze odvrátit nepříznivé důsledky takového zneužití práva.

Abstract:

The authoress deals with defining the bill of exchange law, incl. brief historical survey and the relation this part of law to other legislation. The main part of the work consists of the analysis of the legislation of different types of transfers of the bill of exchange, especially of the types of transfers, which are typical and the most frequent – endorsements. The work includes enumeration and description of the effects of endorsements, and also summary and description of different types of endorsements. Part of the work is also devoted to the practical consequences of use (and abuse) the transfer of the bill of exchange and also to possibilities to eliminate the adverse results of this kind of abuse, which are in the debtor’s disposition.
