The transfer of title to residential and non-residential units

Abstract:

V této práci jsem se zaměřila na převod vlastnického práva bytům a nebytových prostor a s tím související vznik vlastnického práva k jednotkám. Ve svoji práci, první části se věnuji vymezení pojmů. Vymezení pojmů je podstatné z hlediska srozumitelnosti široké veřejnosti, zvlášť pokud vymezený pojem se liší od obvyklostí. V připravovaném zákoně o vlastnictví bytů se má vymezení pojmů ještě rozšířit a tím snad i zamezit např. nejednotnosti v postupech katastrálních úřadů při rozhodování o vkladu práva do katastru nemovitostí. Podstatná část práce obsahuje způsoby vzniku vlastnictví jednotek, a to zejména při přeměně budovy na dům s jednotkami prohlášením vlastníka. Se vznikem jednotek úzce souvisí i jejich následný převod. V mé práci jsem se snažila vybrat a co nejlépe popsat možnosti některých převodů jednotek, zvláště bytových, na náležitosti různých typů smluv o převodu jednotky a poukázat na časté chyby, nesrovnalosti vyplývající z nedokonalosti zákona. K tomu jsem použila i citací ze stanovisek ČÚZK a Judikatury, poznatků, se kterými se setkávám v praxi. Závěrečná kapitola je věnována novému zákonu o vlastnictví bytů. Návrh zákona byl již předložen na začátku roku 2008 Legislativní radě, ta však zatím tento návrh vrátila zpět Ministerstvu pro místní rozvoj. V práci proto vycházím z textu Návrhu zákona, který je k dispozici na webových stránkách Ministerstva pro místní rozvoj ke konci roku 2008.

Abstract:

In this thesis I have focused on the transfer of proprietary right to flats and to non-residential premises and on the related rise of proprietary right to the units. Here I follow definition of terms in the first section of my thesis. Definition of terms is substantial from the point of view of general public especially if defined term differs from used habitualness’s or if it differs from definition in other law. In the prepared law about proprietary rights term definition should expand yet thereby maybe it should stop disunity in progresses of Land Register Offices at decisions about law deposit to the Land Registry, for example. Body of this my thesis contains ways of rise of units ´ownership namely on the transformation of building to the house with units by owner´s declaration. With units ´rise their subsequent transfer too closely relates to. In my thesis I have tried to choose and describe to the nines possibilities of some units´ transfers, especially flat units. Then I have described here differ-ent types and belongings of contracts about unit transfer and I have adverted to frequent mistakes and discrepancies resulting from imperfect law. Here I have used too quotes from views of ČÚZK, Judicature and findings that I meet in my profession. Final chapter is applied to new draft of flats proprietary law. This draft law was presented in the beginning of 2008 to Legislative Council yet. But for the present this Council passed back this draft to Ministry for Local Development. Therefore in my thesis I result from the text of Draft Law that is available on the website of The Ministry for Local Development towards the end of 2008 year.
