Inheritance by will

Abstract:

Abstrakt Tato práce je zaměřena na objasnění problematiky dědického práva a věcí s tímto souvisejícími. V úvodní části práce je nastíněn historický vývoj dědického práva a dále práce pokračuje vysvětlením základních pojmů, které se k tomuto tématu vztahují. Hlavní část je věnována dědění ze závěti a dědickému řízení před soudem. Práce poukazuje na možnost sepsání různých forem závěti, neopomenutelné dědice, v její části je též zmíněno dědění ze zákona. Vysvětluje úlohu notářů v dědickém řízení a v neposlední řadě nezapomíná uvést podmínky podání daňového přiznání a stanovení výše dědické daně a její výpočet. V závěrečné části se práce ještě okrajově zmiňuje o možnosti zasažení trestního práva do práva dědického.

Abstract:

Abstract The thesis' main focus is on illustrating the main questions about heirship in the Czech law system. At the beginning, it shows the historical development of inheritance law and explains the basic definitions related to this topic. Special attention is paid to inheritance by will and to the proceeding law. It is pointed out that there are many ways to conceive a will and to treat a forced heir. Also discussed are situations in which there is no will left, as well as inheritance by law. Finally, the thesis explains the role of public notaries and at the end, conditions of tax declaration, tax range and possibility of interference of criminal law and inheritance law.
