Proof of expert opinion in the field of graphic desing

Abstract:

Abstrakt Práce je věnována tématu znaleckého dokazování v trestním řízení. Jejím cílem bylo provést analýzu současné zákonné úpravy důkazu znaleckým posudkem v trestním řízení, od stádia rozhodnutí o přibrání znalce, zákonem stanovené formy jeho přibrání, přípravy posudku a hodnocení posudku, identifikovat její nedostatky ve smyslu respektování principu zákonnosti a principu kontradiktornosti v trestním řízení. Koncepčně tak byla práce vedena v pojetí vyhodnotit stávající úpravu znaleckého dokazování vzhledem k aktuálně připravované rekodifikaci trestního řádu, jehož hlavní myšlenkou je zefektivnění a zrychlení trestního procesu. Autorka se v souvislosti s hlavním tématem práce v pochopitelné míře zabývá též výkonem znalecké činnosti regulované zákonem o znalcích a tlumočnících, z pohledu dosud účinné této právní normy a aktuálně probíhajících příprav zákona nového. V práci je současně rozpracován historický vývoj znaleckého dokazování v trestním řízení znázorňující postupné změny a přístupy k této problematice v procesu dokazování. Problematika znaleckého dokazování byla autorku v první její části evaluována jak z pohledu její úpravy dané trestním právem procesním, tak i z pohledu řízení občanskoprávního a správního.

Abstract:

Abstract The thesis is devoted to the topic of the expert evidence in criminal proceedings. Its main objective is to carry out an analysis of the current legal provisions concerning the expert opinion evidence in criminal proceedings, beginning by the decision about the inclusion of an expert, the ways of his/her inclusion as required by law, the preparation of the report and the evaluation of the report as well as identification of deficiencies concerning the compliance with the legal principle (princip zákonnosti) and the principle of aud i altera m partem in criminal proceedings. Conceptually, the thesis was conducted in order to evaluate the current regulation of the expert evidence with reference to the currently planned recodification of the criminal procedure code, whose main idea is to improve and to expedite the judicial process. Additionally to the main object of the thesis, the author also deals with the performance of the expert activities as defined in the law on experts and interpreters, in consideration of the currently effective legal standards and the currently ongoing preparations for the new law . The thesis also summarizes the historical development of the expert evidence in criminal proceedings, by showing the gradual changes and approaches to this problematic issue within the process of taking of evidence. In the first part, the topic of the expert evidence was evaluated from the viewpoint of its regulation given by the criminal procedural law, as well as from the perspective of civil and administrative proceedings.
