Proving and Means of Evidence in Civil Legal Proceeding

Abstract:

Dokazování je nejvýznamnější institut procesního práva, a proto je cílem této práce jeho specifikace. V úvodní části je definováno občanské právo procesní, jeho vztahy, subjekty a další souvislosti. V následující části se práce zaobírá druhy civilního řízení a zásadami, které se v něm uplatňují. Řízení sporné a nesporné jsou dvě základní formy občanského soudního řízení, ve kterých mají jejich subjekty určitá práva a povinnosti. Povinnost tvrzení a povinnost důkazní je tak dalším tématem této práce. Samotné dokazování a jeho průběh je nejdůležitějším faktorem každého civilního řízení, na jehož výsledcích je postaveno rozhodnutí soudu. Nedílnou součástí práce jsou důkazní prostředky a jejich charakteristika. V některých kapitolách se věnuji konkrétním případům, které byly rozhodovány soudy a zejména pak judikovány Nejvyšším soudem. V závěru své práce se věnuji zhodnocení důkazních prostředků.

Abstract:

The topic of this thesis is the burden of proof and its specification, which is the most important part of the procedural law. The introduction defines civil procedure and its coherent relations and subjects.The following part of the thesis deals with different forms of lawsuit and principles that are put into effect within .The adversarial and non–adversarial systems are two main forms of civil lawsuit in which the parties have certain rights and obligations. The obligation of the statement and the evidence are other topics of this thesis. The burden of proof and its process is the most important factor of each lawsuit as the verdict is often based on its results. An integral part of the thesis is the means of evidence and their characteristics. Some chapters deal with specific cases that were arbitrated by courts and then abjudicated by the Supreme Court. The last part is dedicated to the evaluation of the means of evidence.
