Alternative punishments

Abstract:

Bakalářská práce se zabývá alternativními tresty – obecně prospěšnými pracemi, trestem domácího vězení a jejich uplatňováním v praxi. V úvodní části je detailněji rozebrána restorativní justice a její principy, následuje rozbor alternativních trestů z hlediska účelu a funkce. Obsahem bakalářské práce je porovnání problematiky trestu obecně prospěšných prací a trestu domácího vězení s obdobnou úpravou ve Velké Británii. Je charakterizován průběh těchto trestů, jejich pozitiva a negativa. Zmíněna je také úloha a zapojení Probační a mediační služby. Cílem práce je vykreslit podstatu zmíněných trestů, jaký je jejich legislativní rámec, jak probíhá jejich výkon a kontrola. Práce vyúsťuje ve zhodnocení jednotlivých kladů a záporů.

Abstract:

This thesis analyses the use of alternative punishments by the judicial system. An examination into aspects such as community service and house detentions/arrests and their implementation in practice is conducted. In the opening section, restorative justice and its principles are discussed in detail, followed by an analysis of alterative punishments in terms of purpose and function. The main content of the thesis is a comparison of the use of community service and house arrest sentences with similar arrangements in the UK. The utilisation of these punishments, their positives and negatives are assessed; with the role and involvement of the Probation and Mediation Service also being discussed. The aim of the thesis is to portray the nature of these punishments; what is their legislative framework and how their execution and control is carried out. The thesis concludes with a critical evaluation of the pros and cons of each.
