The language regime of the European Union

Abstract:

Cílem této rigorózní práce s názvem „Jazykový režim Evropské unie“ je popsat a analyzovat povahu EU a způsob jejího fungování na pozadí mnohojazyčnosti. Z uvedeného důvodu se práce zabývá historickými, lingvistickými, právními, politickými a ekonomickými aspekty fenoménu mnohojazyčnosti v podmínkách EU. Rigorózní práce je členěna do celkem 11 kapitol. V prvé části práce jsou definovány teoretické pojmy jako znak, znakový systém, právní jazyk apod. Účelem druhé kapitoly je pokus o historický exkurs do problematiky postupného konstituování současného jazykového režimu EU. Třetí kapitola si klade za cíl charakterizovat základní pojmy současného jazykového režimu EU. Smyslem čtvrté kapitoly je náležité vymezení jazykového režimu jednotlivých orgánů EU. Pátá kapitola se snaží definičně odlišit a patřičně přiblížit dvě hlavní činnosti spjaté s užíváním vícero jazyků v rámci EU, a to překládání a tlumočení. Cílem šesté kapitoly je určit a následně zanalyzovat, jaký vliv má mnohojazyčné prostředí současné EU na tvorbu jejího práva. Záměrem sedmé kapitoly je provést hlubší sondu do oblasti jazykových aspektů interpretace práva EU. Završením rigorózní práce je její osmá kapitola, která se snaží určit nejcharakterističtější rys práva EU, za který považuje mnohojazyčnost. Mnohojazyčnost je tu posuzována z hlediska svých přínosů i nákladů pro EU, přičemž je zde formulován závěr, že současný mnohojazyčný charakter EU je pro ni až na nečetné výjimky nepříjemnou zátěží a také podstatnou překážkou její další integrace. Z uvedeného důvodu jsou do kapitoly začleněna jednotlivá v úvahu přicházející řešení tohoto stavu, přičemž každé z nich je následně podrobeno náležitému vyhodnocení z hlediska pravděpodobnosti své realizace. Obsahem deváté kapitoly je závěrečná rekapitulace východisek, na jejichž základě byla rigorózní práce zpracována, jakož i poznatků, jichž bylo rigorózní prácí dosaženo. Do desáté kapitoly jsou začleněna závěrečná resumé rigorózní práce, která jsou vypracována v angličtině, francouzštině a němčině. V jedenácté kapitole jsou uvedeny veškeré prameny, které byly při vypracování rigorózní práce použity.

Abstract:

The aim of this rigorous thesis holding the title „The language regime of the European Union“ is do describe and analyse the influence of the multilingualism on the nature and functioning of the EU. From this reason the paper deals with historical, legal, political, linguistic and economic aspects of the multilingualism within the EU. The rigorous thesis is divided into 11 chapters. The first chapter contains the definition of the fundamental theoretic terms like sign, sign system, legal language etc. The objective of the second chapter is an attempt to carry out a historical excursion to the issues of the gradual shaping of the contemporary language regime of the EU. The third chapter sets itself a goal to characterize the basic concepts of the current language regime of the EU. The purpose of the fourth chapter is a proper specification of the language regime of the particular EU institutions. The fifth chapter endeavours to appropriately distinguish and describe two main activities connected with the use of the languages within the EU, namely translating and interpreting. The goal of the of sixth chapter is to set and subsequently to analyse which influence has a multilingual environment of the current EU on its legislation. The intention of the seventh chapter is to perform a deeper research into the sphere of the language aspects of the interpretation of EU law. The completion of the rigorous thesis is its eight chapter which strains to determine the most characteristic feature of the EU law which is considered to be the multilingualism. The multilingualism is assessed here with respect to its benefits nad costs for EU. After making this comparison a conclusion is drawn that the current language character of the EU is regardless of sporadic exceptions an unpleasant burden for it and also an essential obstacle in its further integration. From this reason there are incorporated several possible solutions into the chapter, one after another being examined through an appropriate evaluation from the viewpoint of their probable implementation. The content of the ninth chapter is a final recapitulation of the starting points on which the rigorous thesis has been worked out as well as of the findings that have been revealed by it. Into the tenth chapter there have been embodied the final summaries which are elaborated in English, French and German. In the eleventh chapter there are stated all the sources that have been used for the works on this rigorous thesis.
