The Institute of Game Manager in the Legislation of the Czech Republic and Neighbouring Countries

Abstract:

Práce je zaměřena na analýzu institutu mysliveckého hospodáře v právních předpisech České republiky a v okolních zemích (Slovenska, Německa, Polskaa Rakouska). Hlavním cílem je analýza institutu v historických a platných právních předpisech České republiky a v okolních zemích, včetně vztahu institutu k orgánu státní správy myslivosti. Metodickým přístupem byla zvolena komparační a kompetenční analýza institutu. Součástí práce je dotazníkové šetření k předmětu práce a v závěrečné části jsou zformulovány návrhy právních úprav de lege ferenda. Institut mysliveckého hospodáře byl poprvé zachycen v zákoně z roku 1947. Výsledky práce v rámci legislativního vývoje institutu v České republice ukazují změny v podmínkách pro jmenování a kompetencí, kdy jednou ze změn je lhůta pro jmenování mysliveckého hospodáře. Zákonem z roku 1962 dochází k ustálení těchto základních atributů institutu. Platným zákonem o myslivosti z roku 2001 bylo vytvořeno systematické uspořádání podmínek pro jmenování a kompetencí institutu. V sousedních zemích byla shledána určitá shoda s institutem na Slovensku. Tato skutečnost vyplývá ze společného historického právního státu. V ostatních zemích byla shledána možná podobnost ve Spolkové republice Německo a Rakousku, a to v institutu profesionálních myslivců. Zde je kladen silným důraz na vzdělání. Dotazníkové šetření vyzdvihuje názory myslivecké veřejnosti hodnotící současnou právní úpravu a možné změny kompetencí z pohledu praxe. Návrhy de lege ferenda vznikly na základě celkové analýzy práce, dotazníkového šetření a vlastního pohledu na danou problematiku. Koncepce návrhů je navržena tak, aby přímo navazovala na současné právní předpisy a nedošlo k narušení systematičnosti právních norem. Stěžejní částí návrhů je úprava podmínek pro jmenování, vzdělávání, kompetence institutu a rozvoj vzájemného vztahu k orgánu státní správy. Přínosem práce je vytvoření uceleného pohledu na institut mysliveckého hospodáře v České republice, v sousedních státech a návrhy možných změn využitelné pro praxi.

Abstract:

The work is focused on the analysis of the institute of hunting manager in the legislation of the Czech Republic and in the neighboring countries (Slovakia, Germany, Poland and Austria). The aim of this work was to analyze the institute in the historical and valid legal regulations of the Czech Republic and in the neighboring countries, including the relationship of the institute to the state hunting administration body. The comparative and competence analysis of the institute was chosen as a methodological approach. Part of the work is a questionnaire survey on the subject of the work and in the final part are formulated proposals for legal regulations de lege ferenda.We first meet with the Institute of Hunting Manager in the Act of 1947. The results of work within the legislative development of the institute in the Czech Republic show changes in the conditions for appointment and competencies, one of the changes is the deadline for appointing a hunting manager. The law of 1962 establishes these basic attributes of the institute. The valid Hunting Act of 2001 created a systematic arrangement of conditions for the appointment and competencies of the institute. In neighboring countries, some agreement was found with the institute in Slovakia. This fact follows from the common historical rule of law. In other countries, a possible similarity was found in the Federal Republic of Germany and Austria, in the institute of professional hunters. Here, a strong emphasis is placed on education. The questionnaire survey highlights the opinions of the hunting public evaluating the current legislation and possible changes in competencies from the point of view of practice. The proposals de lege ferenda were created on the basis of an overall analysis of the work, a questionnaire survey and one's own view of the issue. The concept of the proposals is designed so that it directly follows the current legal regulations and does not disrupt the systematic nature of legal norms. The key part of the proposals is the adjustment of the conditions for appointment, education, competences of the institute and the development of a mutual relationship with the state administration body.The contribution of the work is the creation of a comprehensive view of the institute of hunting manager in the Czech Republic, in neighboring countries and proposals for possible changes usable for practice.
