Abstract:

Diplomová práce se zabývá problematikou vývoje bezpečnostní architektury a minulosti, recenzního stavu a výhledu de lege ferenda. Téma je aktuální, protože bezpečnostní rizika jsou všeobsáhlá. První část práce je věnována zhodnocení současného stavu bádání včetně literárních pramenů (teorie). Druhá část je praktická (současnost). Třetí část seznamuje s návrhy, jak by evropská bezpečnostní architektura měla vypadat de lege ferenda. Závěrečná část. Použitými metodami jsou především využití analýzy, komparace, generalizace, interpretace právních textů, analogia iuris. Hlavním cílem práce je artikulace výchozího stavu evropské bezpečnostní architektury pro budoucí proměny včetně možných alternativ mezinárodněprávního charakteru. Zásadní charakteristikou evropské bezpečnostní architektury je soulad s evropskou architekturou v oblasti volného trhu, Evropské měnové unie, vojenské oblasti a v neposlední oblasti schengenského prostoru.

Abstract:

The thesis deals with the development of European security architecture and past, review status and outlook de lege ferenda. The topic is topical because the security risks are all-comprehensive. The first part of the thesis is devoted to evaluating the current state of research, including literary sources (theory). The second part is practical (present). The third part introduces proposals on what the European security architecture should look like de lege ferenda. The final part. The methods used are mainly the use of analysis, comparation, generalization, interpretation of legal texts, analogy and iuris. The main objective of the work is to articulate the initial state of the European security architecture for future transformations, including possible alternatives of an international legal nature. An essential characteristic of the European security architecture is compliance with the European architecture in the area of the free market, the European Monetary Union, the military area and, last but not least, the Schengen area.
