Criminal responsibility of juveniles

Abstract:

Diplomová práce s názevem "Trestní odpovědnost mladistvých" je věnována problematice trestní odpovědnosti mládeže a je rozdělena do sedmi kapitol. Cílem diplomové práce bylo poskytnout ucelený pohled na problematiku trestní odpovědnosti mládeže a zhodnotit tak platnou právní úpravu. Úvodní část se zabývá historickým vývojem trestního zákonodárství na našem území až do vydání platného zákona č. 218/2003 Sb. o odpovědnosti mládeže za protiprávní činy a o soudnictví ve věcech mládeže. Následující kapitola pojednává o současné platné právní úpravě. Úvod této části tvoří stručný přehled mezinárodních dokumentů o mladistvých. Stežejní částí je nastínění struktury zákona č. 218/2003 Sb., o soudnictví ve věcech mládeže. Podrobněji se věnuji jednotlivým druhům opatřením ukládáná mladistvým delikventům. Závěrečné kapitoly se věnují zahraniční právní úpravě trestní odpovědnosti mladistvých a následně návrhy de lege ferenda zaměřenou na snížení dolní věkové hranice.

Abstract:

The diploma thesis entitled "Criminal responsibility of juveniles" is devoted to the issue of juvenile criminal responsibility and is divided into seven chapters. The aim of the thesis was to provide a comprehensive view of the issue of juvenile criminal liability and thus evaluate the applicable legislation. The introductory part concerns the historical development of criminal legislation in the Czech Republic until the Act No. 218/2003 Coll. on the juvenile justice and liability. The following chapter discusses the current legislation in force. The introduction of this section is a brief overview of international juvenile documents. The crucial part is an outline of the structure of the Act No. 218/2003 Coll., the Youth Justice Act. I focus in detail on the individual types of measures imposed on juvenile delinquents. The final chapters deal with foreign legislation of juvenile criminal liability and subsequently with proposals de lege ferenda aimed at lowering the age limit.
