President position in the parliamentary regimes of Central Europe

Abstract:

Prezident, jakožto hlava státu patří k nejvýznamnějším státním orgánům v republice. Díky bližšímu zkoumání instituce prezidenta lze poznat nejen formu ústavní dělby moci, ale také její praktické naplnění a samožrejmě i dějiny daného státu, neboť dost často je prezident přímým aktérem politického dění. Má diplomová práce "Postavení prezidenta v parlamentních systémech zemí střední Evropy" je zaměřená na objasnění postavení a pravomocí instituce prezidenta v demokratických podmínkách parlamentních režimů. Ve své práci si beru za cíl analýzu postavení instituce prezidenta v podmínkách středoevropských zemí. Moderní společnost západního typu proces obsazování vrcholných politických reprezentantů obvykle řeší pomocí institutu voleb. Lze tedy předpokládat, že mechanismus obsazení úřadu prezidenta je jedním z nezbytných předpokladů pro analýzu postavení prezidenta ve struktuře politického systému. Objektem mého výzkumného zájmu jsou čtyři středoevropské země, jmenovitě Česká republika, Slovenská republika, Republika Slovinsko a Rakouská republika. Mnou vybrané země kromě relativní geografické blízkosti spojuje také skutečnost, že kdysi byly po staletí součástí Habsburské říše. Vzhledem k výše zmíněným okolnostem lze předpokládat jistou podobnost ústavního vývoje a to díky geopolitickým, sociologickým a ekonomickým podmínkám, jež panují v regionu střední Evropa. Všechny mnou vybrané země mají také svou vlastní zkušenost s nedemokratickým obdobím vlády. Cílem mé práce je tedy komparace analogických historických situací instituce prezidenta v mnou vybraných zemích. Věřím, že tato komparativní metoda mi umožní užitečným způsobem využít poznatků dosažených vhodným mixem synchronní a diachronní komparativní analýzy a poslouží mi jako vhodný analytický podklad. V prostoru střední Evropy jsme po pádu komunistických režimů svědky trendu zavádění "přímých voleb" prezidenta. Tento trend vedl v politických vědách k mnoha diskusím na poli komparativního výzkumu politických systémů. Tím, že prezidentům byl posílen zdroj jejich legitimity prostřednictvím "přímé volby", došlo k zintenzivní debat o konkrétní formě politického systému nejenom na akademické půdě. Díky poměrně cizorodému prvku přímé volby v podmínkách parlamentního režimu přestal být zřetelný rozdíl mezi parlamentním a poloprezidentským režimem.

Abstract:

The President, as the head of a state, is one of the most important state authorities in the republic. Due to closer examination of the institution of the President, one can recognize not only the form of the constitutional division of power, but also its practical fulfillment and, of course, the history of the state, as the President has quite often direct influence in political affairs. This thesis "Position of President in Parliamentary Systems of Central European Countries" is aimed at clarifying the status and powers of the President's institution in the democratic parliamentary systems. In this work, we analyze the position of the President's institution in Central European countries. Modern western-type societies usually choose the top political representatives with democratic elections. Therefore, it can be assumed that the process of electing the President is one of the prerequisites for analyzing the position of the President in the structure of any political system. The focus of this research is on four Central European countries, namely the Czech Republic, the Slovak Republic, the Republic of Slovenia and the Republic of Austria. We selected these countries, besides from their relative geographic proximity, because they are connected by the fact that they once were part of the Habsburg Empire. Under these circumstances we can assume a certain similarity of constitutional development, due to geopolitical, sociological and the economic conditions prevailing in the Central Europe region. All selected countries also have their own experience with undemocratic regimes. The aim of this thesis is therefore to compare the analogous historical situations of the institution of the President in four selected countries. We believe that this comparative method will allow us to make a useful analytical basis by a suitable mix of synchronous and diachronous comparative analysis. In the region of Central Europe, after the collapse of communist regimes, we witnessed a trend of introducing the "direct elections" of the President. This trend has led to many discussions in the field of comparative research of political systems. The role of Presidents has been strengthened through "direct elections",which led to increased interest of the specifics of the form of political systems not only in academia. "Direct election" of the President decreased the difference between the parliamentary and semi-presidential regimes.
