Disertační práce se zabývá otázkou platnosti rozhodčí smlouvy, přičemž si klade za cíl jednak zhodnotit současnou českou právní úpravu a zároveň ověřit, zda je možné k rozhodčí smlouvě přistupovat jako k výlučně procesnímu úkonu. The study sets out to achieve two aims, not only to examine the present law and rules regulating validity of arbitration agreement but also to determine its nature. The study is based on analysis and comparative methodology.
