Sexually violent crimes - the development of legal regulations in our territory

Abstract:

Rigorózní práce se zabývá právním vývojem sexuálně násilných trestných činů na našem území. Primární zaměření práce tkví v úpravě trestného činu znásilnění a trestného činu pohlavního zneužívání, avšak mimo uvedené se práce na určitých místech zmiňuje také o právní úpravě dalších trestných činů, které se řadily do kategorie sexuální trestné činy. Jedná se zejména například o trestný čin pohlavní-ho styku s osobou téhož pohlaví či trestný čin pohlavního styku se zvířetem. Práce je vzhledem k zaměření tématu rozdělena chronologicky, přičemž počátkem práce je období feudalismu, závěrem poté současnost a seznámení s aktuální právní úpravou předmětných trestných činů. V rámci každého z jednotlivých vývojových období se práce věnuje konkrétním dochovaným právním památkám, případně přímo právním předpisům, které jsou pro zkoumanou právní úpravu podstatné. Nad to je práce na určitých místech obohacena například o archivní výzkum ohled-ně přípravy trestních zákonů či o praktické poznatky z vyšetřování trestných činů.

Abstract:

The Rigorosum thesis deals with the legal development of sexually violent crimes in our territory. The primary focus of the thesis lies in the regulation of the crime of rape and the crime of sexual abuse, but in addition to the above, in some places the thesis also mentions the legal regulation of other crimes, which fell under the category of sexual crimes. In particular, for example the crime of sexual intercour-se with a person of the same sex, or the crime of sexual intercourse with an animal. Due to the focus of the topic, the thesis is divided chronologically, it begins with the period of feudalism and ends with presentation of the current legislation of the crimes in question. Within each of the individual development periods, the thesis deals with specific preserved legal monuments, or directly legal regulations, that are essential for the examined legislation. Furthermore in certain places, the thesis is for example enriched by archival research on the preparation of criminal laws, or by practical knowledge from the investigation of criminal offenses.
