Abstract:

Diplomová práce se zabývá trestní odpovědností právnické osoby. Její implementací do právního řádu České republiky. V práci se seznamujeme i s působností, přechodem a zánikem trestní odpovědnosti. Přičitatelností a možností právnické osobě vyvine se. Dále ve své práci uvádím právnickou osobu ve smyslu pachatel, spolupachatel a účastník trestného činu. Důraz v této práci je veden na přechod trestní odpovědnosti na právního nástupce. Kdy se tento institut jeví jako nejvíce problematický v celém právním předpisu. Samozřejmostí je postihnutelnost za trestné činy a tedy výčet trestů a ochranných opatření. V neposlední řadě jsou zde zahrnuty i úvahy de lege ferenda.

Abstract:

The diploma thesis deals with the criminal responsibility of a legal entity. Its implementation into the legal system of the Czech Republic. At work, we also get to know the scope, transition and termination of criminal liability. Attributability and possibility to a legal entity will develop. Furthermore, in my work I introduce a legal person in the sense of perpetrator, accomplice and participant in a crime. The emphasis in this work is on the transfer of criminal responsibility to the legal successor. When this institute appears to be the most problematic in the entire legislation. It goes without saying that there is a disability for criminal offenses and therefore a list of punishments and protective measures. Last but not least, de lege ferenda considerations are also included here.
