Trade Entrepreneurship in the Czech Republic, comparison with Slovakia

Abstract:

Bakalářská práce umožňuje seznámit se nejen s živnostenským zákonem České a Slovenské republiky, ale také s dalšími souvisejícími právními předpisy, které jsou nedílnou součástí legislativního rámce obou zemí. Význam této práce spočívá ve vytvoření uceleného přehledu o živnostenském podnikání jednak z pohledu podnikatelského subjektu a jednak z pohledu státní správy. Důležitou částí práce je vytvoření praktického příkladu, který reálným způsobem vystihuje skutečný postup vyřizování živnostenského oprávnění. Tato práce je koncipována tak, aby jednoduše a přehledně vystihla aspekty živnostenského podnikání a současně posloužila jako rádce v jeho začátcích. Komplexní porovnání procesu živnostenského podnikání obou států umožnilo vymezit rozdíly v této oblasti a zhodnotit, zda bylo účelně dosaženo záměru, který vyplynul z potřeby reagovat na měnící se živnostenské prostředí. Závěrem lze konstatovat, že vytyčené cíle zákonodárců byly vhodně navrženy, avšak některé kroky a postupy k nim vedoucí naopak neúčelně poznamenaly celkový proces živnostenského podnikání.

Abstract:

The bachelor thesis makes possible to get acquainted not only with the Act to Regulate Trades in the Czech Republic and the Slovak Republic, but also with other related legal regulations which are the inseparable part of the legislative scope of both countries. The importance of this work consists in making the complete survey of business in trade both from the point of view of the entrepreneur subject and from the point of view of the state administration. The important part of this work is to make a practical example which by the real way describes the real procedure of attending the trading certificate. This work is framed in the way to describe aspects of business in trade activities in the simply and well-arranged way and at the same time as the guide at its beginning. The complex comparison of the process of business in trade of both states makes possible to specify the differences in this area and to evaluate whether the intention resulted from the need to react on changing business in trade environment was achieved purposefully. Finally it can be stated that the set targets of the legislators were proposed appropriately, however, some steps and procedures leading to them on the contrary unsuitably marked the process of business in trade.
