Sociological-legal Concepts of Death Penalty

Abstract:

Diplomová práce se zabývá sociologicko-právním pohledem na trest smrti. Na začátku je zmíněn jeho historický vývoj až po současnou právní úpravu. Jsou uvedeny jednotlivé funkce trestu jako takového a funkce trestu smrti se souvisejícími pravidly k jeho realizaci. Trest je zmíněn i v podobě sociální sankce, která je uložena na základě vykonané sociální kontroly. Práce se dále ubírá k pohledu dnešní společnosti na trest smrti. Jaké jsou argumenty hovořící ve prospěch a v neprospěch jeho ukládání s následným grafickým znázorněním pohledu občanů České republiky na danou problematiku. Uvedena bude alternativa k trestu smrti, a to trest odnětí svobody na doživotí s jeho pozitivními i negativními vlastnostmi. Je vysvětlen pojem resocializace a pozornost se ubírá k nápravě vězňů a jejich následnému vzájemnému vztahu se společností. Nutností je zmínit také mezinárodní pohled na trest smrti a jeho uplatnění ve světě (Čína, USA). Důležitou roli hrají jednotlivé mezinárodní dokumenty, upravující právo na život a možnost ukládání trestu smrti. K závěru práce jsou uvedeny dva případy z praxe. Soudní spor s Miladou Horákovou a z mezinárodní situace spor s německým občanem Soeringem.

Abstract:

The diploma thesis deals with the sociological-law view on the death penalty. The historical evolution up to the current legal forms is mentioned at the beginning of the thesis. There are described individual functions of the punishment and the functions of the death penalty with the related rules into its realization. The punishment is also mentioned by means of the social sanction, which is realized on the basis of executed social control. The thesis continues with the views of the present society on the death penalty. Moreover, there are the arguments for the benefits and for detrimental of the death penalty of the citizens of the Czech Republic, which are latterly diagrammatized. The alternative of the death penalty will be introduced, namely the life imprisonment with the positive and negative qualities. The conception of resocialization is explained in the thesis and the attention proceeds to the remedy of prisoners and their relationships with the society. There is the necessity of mentioning the international view on the death penalty and its application in the world (China, USA). The important roles enact individual international documents, conditioning the right to life and the possibility of the death penalty. There are included two cases from the real life at the end of the thesis. The first one deals with the pursuit with Milada Horakova and the second pursuit is with German citizen Soering.
