Cílem této práce je porovnat stávající právní úpravu zajištění závazků s novou úpravou, kterou přinese zákon č. 89/2012 Sb., občanský zákoník. V práci jsou nejen popsány tyto rozdíly, ale také zhodnocen jejich přínos či nedostatky. Současně je zkoumána použitelnost dosavadní judikatury na novou právní úpravu. The crucial point of this thesis is the comparison of existing legislation of securing and confirming legal obligations with legislation, which brings act No. 89/2012 Sb., Civil Code. The thesis is not only the description of the differences but also evaluation of their strengths and weaknesses.
