Abstract:

Obsahem práce je souhrn úkonů, které provádí orgán Policie ČR při prvotním zásahu na místě činu a jejich rozbor a také souhrn a rozbor oprávnění, kterými je orgán Policie ČR v souvislosti s těmito úkony vybaven. Prvotní zásah na místě činu je v praxi orgánů činných v trestním řízení stále podceňován. Důvodem je zřejmě jednak podceňování samotného významu prvotního zásahu, ale také neznalost postupů a práce při prvotním zásahu na místě činu u začínajících policistů. Prvotní zásah provedený na místě činu je výchozím bodem k objasnění vyšetřované události. Každá chyba nebo nedostatek související s prvotním zásahem na místě činu má za následek vážné narušení další činnosti a mnohdy je případ zařazen mezi neobjasněné jen z tohoto důvodu. Cílem mé práce je tedy poukázat na důležitost prvotního zásahu na místě činu vzhledem k další orientaci vyšetřování, řádnému vyšetření věci i úspěšnosti trestního řízení. Dále bych chtěl v práci rozebrat a v závěru práce zhodnotit oprávnění orgánu Policie ČR v souvislosti s prvotním zásahem na místě činu a poukázat na negativní vlivy a překážky, které mohou v souvislosti s tímto zásahem na místě činu nastat.

Abstract:

The Thesis deals with an analysis of individual acts connected with the primary intervention of the Police of the Czech Republic at a locus delicti as well as analysis of competences the primary intervention bodies are provided. The individual acts connected with the primary intervention at a locus delicti do not necessarily be always exactly the same as described in the Thesis. They may differ case to case and are influenced by the situation at the locus delicti. In practice there are typically numerous negative factors and obstacles to make the primary intervention more complicated. These can include technical obstacles (radio station failure) or those arising e.g. in case of lack of information, its inaccuracy, impossibility to get in touch with the notifying person at the locus delicti, etc. During the primary intervention at the locus delicti there is also a frequent conflict of interests among individual acts, when due to one act there is no possibility to perform efficiently the following one, e.g. when chasing an offender trying to escape from the locus delicti the place with any possible traces cannot be safeguarded, etc. Therefore, if circumstances allow so, it is better to send more patrols to the locus delicti, e.g. in big cities concurrently PMJ patrols and local police department patrols to allocate tasks and ensure efficient performance of the primary intervention at the locus delicti. As far as competence of the Police of the Czech Republic connected with the primary intervention at the locus delicti is concerned, I am of the opinion, based on my actual practical experience, that the current legal regulation is satisfactory and I have no excepts against it. To sum up, it should be emphasized that there cannot be any universal and inflexible directions prescribing how to act in each individual case. A policeman always acts according to actual situation and his own possibilities. Protection of peoples lives and health have the omnipresent priority to anything else.
