Insolvency and methods of its resolution in practice

Abstract:

Tato bakalářská práce se zabývá problematikou insolvence a způsoby jejího řešení v praxi. Práce se skládá ze dvou částí, části teoretické a praktické, které jsou dále děleny na jednotlivé kapitoly a subkapitoly. Teoretická část pojednává o historii úpadkového práva na českém území, vymezuje základní pojmy spojené s insolvencí a popisuje jednotlivé fáze insolvenčního řízení. V první kapitole praktické části jsou uvedeny podmínky, které je nutné splnit pro vyhlášení úpadku. Druhá kapitola se zabývá stěžejním tématem celé práce, kterým je popis praktického příkladu insol-venčního řízení v konkrétní společnosti. V závěru praktické části této práce jsou dána doporučení, jak se vyhnout insolvenci.

Abstract:

This bachelor thesis deals with the insolvency and methods of its resolution in practice. The thesis consists of two parts, the theoretical and practical one, which are further divided into individual chapters and subchapters. The theoretical part focuses on history of bankruptcy law on the Czech territory, defines the basic terms connected to insolvency and describes the individual steps of the insolvency pro-ceedings. The first chapter of the practical part includes the conditions which have to be met for declaring bankruptcy. The crucial part of this thesis contains the se-cond chapter of the practical part which is description of the particular insolvency proceedings of a specific company. At the end of the practical part of this thesis there are recommendations how to avoid insolvency proceedings.
