Administrative Delicts in the Practice of Small Municipalities

Abstract:

Tato bakalářská práce je zaměřena na řešení přestupků podle přestupkového zákona. Po vymezení pojmu přestupek definuje hranici mezi soudními a správními delikty a všímá si správních deliktů. Současně pojednává o pramenech přestupkového práva a zabývá se právní úpravou přestupků v jejich hmotném i procesním aspektu, zejména přestupků projednávaných obcí. Jádro práce tvoří řízení o přestupcích na malých obcích. Podrobně si všímá jednání přestupkové komise v souladu se zákonem, složení komise a způsobu rozhodování. Pro řešení přestupků na obcích je důležitou součástí státní správy možnost uzavřít veřejnoprávní smlouvu. Uzavíráním smluv, postupem a důsledky se zabývá šestá kapitola této bakalářské práce. Závěrečná část práce analyzuje vývoj správního práva z hlediska přestupků a hodnotí tento vývoj v návaznosti na platné právní předpisy.

Abstract:

This bachelor's thesis is focused on dealing with offenses of the Act of Misdemeanours. After definition of offence it defines the boundary between judicial and administrative offenses and it observes the administrative offenses. At the same time it deals with the sources of criminal law and legislation dealing with violations of their substantive and procedural aspects, in particular offenses dealt in municipalities. The basis of the work consists of misdemeanor proceedings in small communities. An attention is paid to Infractions Committee hearing in the accordance with the law, the composition of the committee and decision-making. For dealing with the offenses in the municipalities it is very important to be able to enter a public contract. The sixth chapter of this thesis is about contracting, the procedures and consequences. The final part analyzes the development of administrative law in terms of violations and it rates the development in connection to current legislation
