Methodology of interpretation of the regulation of debt relief

Abstract:

V této práci, jež je určena především odborné veřejnosti zabývající se oddlužením, je určen koncepční základ právní úpravy oddlužení, zejména ve vztahu k účelu oddlužení. Ve vztahu k oddlužení práce rozvádí recentní metodologii interpretace právních norem a přehledně uvádí hierarchii interpretačních metod. Na základě této práce, v které jsou propojeny poznatky z filosofie práva, teorie práva, teorie zabývající se metodologií interpretace práva, civilního procesu obecně a teorie zabývající se úpadkovým právem, je možné právní normy týkající se oddlužení soustavně a systematicky poznávat.

Abstract:

In this thesis, which is intended primarily for the professional public dealing with discharge of residual debt, is determined conceptual basis of the legislation dealing with discharge of residual debt, especially in relation to the purpose of discharge of residual debt. In relation to the discharge of residual debt, this thesis expands recent methodology of interpretation of legislation and provides an overview of the hierarchy of interpretation methods. Based on this thesis, in which are linked insights from the philosophy of law, theory of law, theory dealing with the methodology of interpretation of the legislation, civil proceeding in general and the theory dealing with the insolvency law, makes the possibility continuously and systematically explore the legislation dealing with discharge of residual debt.
