Intellectual Property Protection of Imported Goods into EU from Third Countries

Abstract:

Research objectives of this thesis is to analyze the legislation and procedures to protect intellectual property when goods are imported into EU, this means that attention is focused primarily on measures and practices against goods at EU external borders. The aim is to highlight the practical implications and consequences for individuals. The author comes out of a hypothesis that each act, which regulates the protection of intellectual property on goods imported into EU from third countries, includes certain legal mechanisms for balancing the interests of parties to serve on the effective protection of intellectual property rights against violations, but maintain a certain equality of parties and prevent possible abuses of the system, whether by the rights holders or other persons. The text of the thesis analyzes the referred legislation and critically reflects it as well and evaluates its benefits and problematic aspects, from the perspective of right holders, but also from the perspective of others persons involved. In some cases thoughts de lege ferenda are provided. More attention is paid to mutual relations and differences between the acts. Commentary is supplemented, when appropriate, by significant case law relating to the issue.

Abstract:

Výskumným cieľom tejto práce je analyzovať právne predpisy a postupy na ochranu duševného vlastníctva pri dovoze tovaru do EÚ, to znamená, že pozornosť je zameraná najmä na opatrenia a postupy voči tovaru na vonkajších hraniciach. Cieľom je upozorniť na ich praktický dopad a dôsledky pre jednotlivca. Autorka vychádza z hypotézy, že každý právny predpis, ktorý upravuje ochranu duševného vlastníctva pri dovoze z tretích krajín, zahrňuje právne mechanizmy na vyvažovanie záujmov zainteresovaných strán tak, aby bola zaistená účinná ochrana práv duševného vlastníctva proti porušovaniu, ale zároveň zachovaná určitá rovnosť strán a aby sa zabránilo prípadnému zneužívaniu systému, či už nositeľmi práv alebo inými osobami. Text práce analyzuje právne predpisy a kriticky ich reflektuje a hodnotí prínosy a problematické aspekty z pohľadu nostieľov práv, ale aj z pohľadu ostatných zúčastnených osôb. V niektorých prípadoch sú predstavené úvahy de lege ferenda. Väčšia pozornosť je venovaná vzájomným vzťahom a rozdielom medzi právnymi predpismi. Komentár je na vhodných miestach doplnený významnou judikatúrou vzťahujúcou sa k danej otázke.
