Abstract:

V první části nabízí práce o „Normativní regulaci společnosti“ interpretaci antického mýtu o Oidipovi, kterou dokumentuje některé obecné a nadčasové problémy normativní regulace. V části druhé rozvíjí text tezi, podle níž normy, které stanoví, že něco být má, mohou plnit svou sociální funkci jen potud, pokud jsou v sociálních komunikacích vůbec srozumitelné a smysluplné – závazné – určité premisy, které hovoří o tom, co je. V části třetí pak práce ukazuje, že teritoriální stát a teritoriální právo prodělávají v éře sil, jež jsou transnacionální, hlubokou transformaci, která souvisí s úpadkem jejich schopnosti autorsky řídit procesy, jež mají globalizovaný charakter. Oslabení řádotvorné síly státu souvisí s tím, že je stát nucen normativně regulovat procesy, které sám do značné míry neutvářel, jeho přetrvávající normativní suverenita není dostatečně podepřena suverenitou faktickou, což vysvětluje i úbytek legitimity státu a práva v kontextu globalizované společnosti.

Abstract:

The initial chapter of the „Normative regulation of society“ provides an interpretation of the ancient myth about Aedipus and documents some general and timeless issues of normative regulation. The second part cultivates thesis according to norms that specify that something should be, can only carry out its function if certain premises in social communication – comprehensible and meaningful – speak about what is. The third part illustrates that in the era of transnational powers a territorial state and territorial law udergo deep transformation connected to the decay of their ability to be authors and directors of processes of globalized nature. The weakening of the normative power of state depends on that fact that the recent state is forced to normatively regulate processes that it did not create, its normative sovereignty is not sufficiently supported by factual sovereignty, which also explains the decrease in state legitimacy and of law in the context of a globalized society.
